The owner/operator shall apply for a new Use Permit if a <br /> new vehicular access from Horgan Ranch is proposed. <br /> '-' <br /> 3. All salvage material and equipment stored outdoors shall be removed within 30 <br /> days. The applicant shall submit plans for review/approval by the Zoning <br /> Administrator for all new enclosures/appurtenant structures (including trash.) <br /> 4. The applicant shall install a new seven foot high fence (subject to a building <br /> pennit and approval of adjoining property owners, if located on property line) of <br /> solid sound attenuating materials along the interior property lines of the property <br /> with the exception of the first 20 feet from the street right of way line, where three <br /> feet is the allowed maximum (in compliance with Section 35.7a), within 90 days <br /> from the date of this hearing. <br /> 5. The applicant shall submit a lighting plan to the Planning Division for review and <br /> approval by the City within 30 days from the date of this hearing. (The <br /> owners/operators will submit a plan for City approval.) <br /> 6. The owner shall submit plans and obtain architectural permit approvals for a <br /> landscape/irrigation plan in compliance with Section 35.6 b) d», including the <br /> incorporation of five 24-inch box trees along the eastern property line, to the <br /> satisfaction of the City, within 30 days from the date of this hearing. <br /> ~ 7. The owner shall comply with Section 35.5, effective immediately. <br /> Speaking to the motion, Councilman Claire said he had asked the owners/operators <br /> how many gallons they pumped per day, and Mr. Saberi said currently it was 185,000 <br /> and before the station closed it was 220,000. "That indicates to me that right now <br /> with a third island they are not pumping more they are pumping less.... I have gone <br /> through a lot of pennitting processes in my days and if I got that permit that said tank <br /> remediation, period, I would have gone back through the pennit process and said, <br /> wait, I want an island written down on that pennit. . .. The fact of the matter is, I have <br /> seen the island.... I can't imagine anybody in their right mind would have approved <br /> that island. That island needs to go." <br /> Councilwoman Buchan expressed her dismay at the petitions that came to the <br /> Council suggesting that the City intended to close down the station. She said that was <br /> never the intent of the City. Councilwoman Buchan said she was disturbed that <br /> Planning Director Jany had been "made out to be the bad guy" when he was simply <br /> carrying out the wishes of the Council under the laws of the City. She said the <br /> conditions recommended by staff were needed to have this business comply with the <br /> laws of the City. Councilwoman Buchan said these types of hearings were taken <br /> very, very seriously and no one ever wanted to shut a business down. "We want to <br /> '-' find a way to make it work."
