developed. Insofar as what this Ordinance speaks to is, when we are talking about
development we are talking about use here." City Attorney Schricker said the
adjoining lot did not have to have any development on it. He added "I think it is fair
for the Council to take into consideration the use of the property even though the
Ordinance says residential development. If property is used as a residence.... The
question before you is, mID' not that be viewed as a residential development. By
residence I mean property that is occupied essentially 24-hours a day as a home place
for the occupant.... I think you are entitled to use a definition which is practical and
reasonable. A strained definition is to speak in tenus of residential developments
merely as.... house after house after house after house, in other words a development
of residences. I think it is fair to interpret this Ordinance to say a residential
development as opposed to a development of residences. A fine distinction."

In response to Council questions, Mr. Tom Saberi said he had twelve stations and
they all had more than two gas pump islands.

In response to Council questions, Mr. Tom Saberi said the owners/operators of the
Woodside Gas Mart would agree to fixing the fence, operate between the hours of
6:00 a.m. to 11 p.m., and make minor adjustments to the lighting. Mr. Andy Saberi
described how they planned to reduce the glare of the current lighting, and agreed to
add landscaping to comply with the City's requirements. Council Asked Mr. Andy
Saberi to submit lighting and landscaping plans to which Mr. Saberi replied "no
problem." Director Jany said had the plans for the 3'd island
been brought to the Planning Department before they went ahead and built it, a pennit
for a 3nJ island would have been denied on safety grounds, as that station is on an
undersized lot as it is (11,000 instead of 20,000.)

MIS: CLAIREIBUCHAN TO ACCEPT STAFF RECOMMENDATIONS AND
ATTACH THE FOLLOWING CONDITIONS TO THE USE PERMIT FOR 895
WOODSIDE ROAD GAS MART

1.
