The conditions above-described constitute a public nuisance, <br /> detrimental to the health, safety, peace, comfort, and general welfare of persons <br /> residing or working in the neighborhood of the Property and the public, and <br /> injurious to property or improvements in the neighborhood and the general <br /> welfare of the City. <br /> 3. Continued operation of the service station business on the Property is <br /> hereby expressly conditioned upon the following requirements: <br /> a. Operations shall not commence before 6 a.m. and shall <br /> terminate not later than 11 p.m., daily, and fuel deliveries <br /> shall be scheduled for off-peak business hours, effective <br /> upon the date hereof; <br /> b. The third, newly-installed service island in the vicinity of the <br /> driveway on Horgan Avenue shall be removed within thirty <br /> (30) days of the date hereof; <br /> c. All salvage materials and equipment stored out of doors in <br /> open view shall be removed within thirty (30) days of the <br /> date hereof; further, the Owner shall submit plans for fencing <br /> ~ or screening or other provisions for covered storage of <br /> materials and equipment and refuse containers to the <br /> Zoning Administrator for said Administrator's review <br /> pursuant to the provisions of Zon. Ord. Section 35.8 and <br /> installation of such facilities shall conform to the plans as <br /> approved by the Zoning Administrator; <br /> d. The Owner shall submit plans and apply for a building permit <br /> for the installation and construction of a 7-foot high fence <br /> (which shall be deemed a variance from the provisions of <br /> Zon. Ord. § 35.7a) to be constructed of solid, sound <br /> attenuating material along the interior property lines of the <br /> Property, except for the first 20 feet from the street right-of- <br /> way line, which shall be 3 feet in height. Said plans and <br /> installation (except as to height) shall conform to the <br /> requirements of Zon. Ord. Section 35.7. If installation <br /> thereof is proposed to be made on a property line, such <br /> installation shall be subject to approval of the owners of the <br /> property so affected. The installation of said fence shall be <br /> made within ninety (90) days from the date hereof and shall <br /> conform to the plans as approved by the Building Official of <br /> - the City of Redwood City; <br /> MINUTE BOOK NO. 55 <br /> Fndgs-3 Page No.043 <br />
