By motion, approve the Final Map for lot merger at 525 Middlefield Road. <br /> 2. By motion, approve and authorize the City Manager to execute an Improvement <br /> Agreement with Downtown RWC RES, LLC, a Delaware limited liability company. <br /> 3. By motion, approve and authorize the City Manager to execute a Landscape <br /> Maintenance Agreement with Downtown RWC RES, LLC, a Delaware limited liability <br /> company. <br /> 4. By motion, approve and authorize the City Manager to execute a Stormwater <br /> Treatment Measures Maintenance Agreement with Downtown RWC RES, LLC, a <br /> Delaware limited liability company. <br /> BACKGROUND <br /> Downtown RWC RES, LLC, a Delaware limited liability company, is the Owner of <br /> Record of real property located at 525 Middlefield Road and is the developer <br /> responsible for the construction of all improvements on the site. The project will create <br /> a new mixed use project comprised of three ten-story towers and several two to three <br /> story podium buildings above a three level parking structure, commercial space and a <br /> leasing office. <br /> The existing site consists of seven one- and two-story buildings with surface parking. <br /> The existing uses include San Mateo Credit Union, the Baker's Union, Wings Learning <br /> Center, and various small offices. On September 3, 2013, the Planning Commission <br /> conducted a public hearing in accordance with applicable requirements of the State <br /> Planning and Zoning law and the Downtown Precise Plan to consider approval of the <br /> Planned Community Permit Application No DPC2012-09. On September 3, 2013 the <br /> Planning Commission adopted Resolution No. 13-21 approving the tentative map, <br /> condominium permit, planned development permit and a planned community permit <br /> pursuant to the Downtown Precise Plan and subdivision ordinance and a Notice of <br /> Official Action was issued. The Planning Commission's determination was appealed to <br /> the City Council. <br /> On November 18, 2013, the City Council reviewed an amended project from the one <br /> approved by the Planning Commission. This amended plan was the result of <br /> negotiations between the project proponent and the appellant. The City Council <br /> adopted Resolution No. 15305 denying an appeal and modifying the September 3, 2013 <br />
