7.1.F. - Page 65 <br /> ARTICLE I. DEFINITIONS <br /> 1.1. "Annexation": The process whereby Annexation Property is added to the Project as <br /> additional Phases pursuant to the provisions of Section 2.8. <br /> 1.2. "Annexation Property": The real property described in Exhibit "B" attached to this <br /> Declaration which may be annexed to and become a part of the Project pursuant to Section 2.8.A <br /> of this Declaration. <br /> 1.3. "Architectural Control Committee" or "Committee": Architectural Control Committee <br /> created pursuant to Section 7.10. <br /> 1.4. "Articles": The Articles of Incorporation of the Association, as amended from time <br /> to time. <br /> 1.5. "Assessment": The cost of inspecting, maintaining, improving, repairing, operating <br /> and managing the Project ,including Reserves, which is to be paid by each Owner as determined <br /> by the Association, and shall include Regular Assessments, Special Assessments, Reimbursement <br /> Charges. <br /> 1.6. "Assessment Lien": A lien imposed by the Association on a Unit to collect a <br /> delinquent Assessment pursuant to Civil Code § 5675. <br /> 1.7. "Association": The Indigo Community Association, a California nonprofit mutual <br /> benefit corporation, the Members of which shall be the Owners of Condominiums in the Project. <br /> 1.8. "Association Common Area": Those portions of the Project shown on the <br /> Condominium Plan as "Association Common Area" which shall include all of the Project with the <br /> exception of the individual Units and with the exception of the Building Common Areas. The <br /> Association Common Area includes, without limitation, land and airspace (except that airspace <br /> within the Building Common Area portions of the Project and the Units). The Association Common <br /> Area shall include the land of the Project and the concrete Podium Structure of the Project, <br /> including the Garage Improvements within the Podium Structure, excluding any Units located <br /> therein, including, but not limited to the following: the foundation; structural supports, beams, <br /> columns, girders, ceiling joists, concrete floors, sub-floors, unfinished floors; exterior walls and trim; <br /> windows; roof; entry lobby; exterior doors; bearing walls; sprinklers; ducts, shafts, sprinkler pipes <br /> and vents; staircases; stairways, fire detection and prevention and life safety systems; reservoirs; <br /> tanks; pumps; meters; ducts; flues; chutes; conduits; pipes; plumbing; wires; utility meters and <br /> other utility installations within the Association Common Area. Association Common Area shall <br /> include the utility rooms and trash rooms; trash chutes; the Garage, the parking spaces and <br /> driveway aisles situated within the Garage. The Podium of the Project including the Podium <br /> landscaping and other facilities and Improvements situated on the Podium, the Podium surfaces <br /> and the portions of the concrete structure that constitutes the Podium and waterproof membranes <br /> shall be part of the Association Common Area. The Association Common Area is to be owned by <br /> the Association pursuant to Section 2.2.B. The costs and expenses for the maintenance, repair <br /> and replacement of the Podium landscaping and other facilities and Improvements situated within <br /> and upon the Podium, exclusive of the areas that constitute the Garage and any Units within the <br /> Podium area shall be allocated as Residential Common Expenses pursuant to Section 4.5.C. <br /> 1.9. "Board" or "Board of Directors": The governing body of the Association. <br /> 1.10. "Budget": A written, itemized estimate of the Association's income and Common <br /> Expenses prepared pursuant to the Bylaws. <br /> 1.11.
