<br /> 1.12. "Building Common Area": Those portions of the Project that are described and
<br /> identified on the Condominium Plan as the Building Common Areas, with the exception of the
<br /> individual Units, within the outside perimeter walls and boundaries of each Building as each
<br /> Building is described on the Condominium Plan, including all Improvements other than the Units
<br /> within the Building Common Area, including but not limited to, patios, balconies and decks of such
<br /> Buildings and including staircases, elevators, elevator shafts, and other items permanently affixed
<br /> to the Condominium Building. The Building Common Area includes, without limitation: outside
<br /> perimeter walls, decks, balconies, patios, bearing walls, columns, girders, ceiling joists, any beams
<br /> in cathedral ceilings, sub-floors, unfinished floors, roofs, and foundation; any chimneys and flues;
<br /> those portions of any heating, ventilating and air conditioning systems ("HVAC systems") serving
<br /> the Building (excluding any components of such HVAC systems that exclusively serve a Unit); any
<br /> central water heaters, smoke/carbon monoxide and heat detectors (including those located within
<br /> the Units), fire life safety systems for the Building; reservoirs, tanks, pumps, motors, ducts, and
<br /> chutes; conduits, pipes, plumbing, wires, utility meters and other utility installations (except the
<br /> outlets thereof when located within the Unit, and except as provided in Section 2.2.A) of the
<br /> Building, and all other Improvements permanently affixed to the Building, with the exception of the
<br /> Improvements located within the boundaries of a Unit as described in Section 2.2.A and the
<br /> Association Common Area.
<br /> 1.13. "BRE": The California Bureau of Real Estate and any department or agency of the
<br /> California state government that succeeds to the BRE's functions.
<br /> 1.14. "Bylaws": The Bylaws of the Association, as amended from time to time.
<br /> 1.15. "City": The City of Redwood City, a municipal corporation.
<br /> 1.16. "Civil Code": The Civil Code of the State of California.
<br /> 1.17. "Close of Escrow": The date on which there is recorded in the Official Records of
<br /> the County a deed conveying a Residential Unit from Declarant pursuant to a transaction requiring
<br /> the issuance of a Public Report for the Project.
<br /> 1.18. "Commercial Condominium": A Commercial Unit and the interest in the Common
<br /> Area that is appurtenant to that Commercial Unit.
<br /> 1.19. "Commercial Tenant" or "Commercial Tenants": The tenant(s) or lessee(s) of the
<br /> individual commercial space(s) contained within the Commercial Unit.
<br /> 1.20. "Commercial Unit": The Units shown on the Condominium Plan as a Commercial
<br /> Unit designated as Commercial Unit A and Commercial Unit B.
<br /> 1.21. "Commercial Unit Parking Spaces": The Commercial Unit Parking Spaces that are
<br /> described in Section 2.4.B.
<br /> 1.22. "Commercial Unit Owner": The Owner of a Commercial Unit.
<br /> 1.23. "Common Area(s)": The Association Common Area and the Building Common Area,
<br /> as described in Sections 2.2.B, 2.2.0 and 2.2.D.
<br /> 1.24. "Common Expenses": Those costs and expenses for which the Association is
<br /> responsible under this Declaration, including, but not limited to, the following actual and estimated
<br /> costs and expenses for the following: (a) inspecting, maintaining, repairing, replacing, managing
<br /> and operating the Common Areas of the Project, including, but not limited to, the Garage of the
<br /> Project; (b) all utilities for the Common Areas, or that are provided to the Condominiums by the
<br /> Association and are not separately metered to the Condominiums, and any other utilities or
<br /> services (such as trash removal) that are billed to the Association for the benefit of the Project;
<br /> (c)managing and administering the Association, including compensation for managers, accountants,
<br /> attorneys, and employees; (c) inspection, maintenance, repair and replacement of Common Area
<br /> improvements and facilities required by this Declaration and all other expenses incurred by the
<br /> Association for the common benefit of the Owners, including the cost of inspection and
<br /> maintenance, janitorial services, elevator maintenance and other inspection and maintenance
<br /> services that benefit the Common Areas of the Project; (e) premiums for all insurance covering the
