7.1.F. - Page 70 <br /> 1.66. "Project": All of the real property in Phase 1, described on the Map and <br /> Condominium Plan, and all improvements on that real property, and any subsequent Phase which <br /> may become annexed into the Project in accordance with Section 2.8, and thereby which become <br /> subject to this Declaration. <br /> 1.67. "Podium": Those portions of the Association Common Area designated on the <br /> Condominium Plan as "Podium" that are located outside of a Building and which consists of those <br /> areas shown on the Condominium Plan as the podium structure of the Project that is situated <br /> above the Project's Garage including the surface areas situated above the Garage and the roof <br /> surface and roof membrane thereof and all landscaping and improvements located on or within the <br /> Podium. <br /> 1.68. "Public Report": The official document and permit issued pursuant to the <br /> Subdivided Lands Act (Business & Professions Code §§ 11000 et seq.) by the State of California <br /> Bureau of Real Estate authorizing the offering of the Residential Condominiums for sale to the <br /> public. <br /> 1.69. "Regular Assessments": A Regular Assessment determined and levied pursuant to <br /> Section 4.3.A of this Declaration. <br /> 1.70. "Reimbursement Charge": A charge levied by the Board against an Owner to <br /> reimburse the Association for costs and expenses incurred in bringing the Owner and/or his or her <br /> Unit and/or Occupant into compliance with the provisions of this Declaration, determined and <br /> levied pursuant to Sections 4.10 and 5.1.A of this Declaration. <br /> 1.71. "Reserves or Reserve Funds": That portion of the Common Expenses collected as <br /> part of the Regular Assessments levied against the Condominiums in the Project allocated (i) for <br /> the future repair and replacement of, or additions to, the Major Components which the Association <br /> is obligated to maintain pursuant to this Declaration, including Reserves for replacement of <br /> structural elements and mechanical equipment or other facilities maintained by the Association; and <br /> (ii) to cover the deductible amounts of any insurance policies maintained by the Association. <br /> 1.72. "Reserve Study": The tri-annual study of Major Components of a Common Interest <br /> Development required by Civil Code Sections 5550 and 5560. <br /> 1.73. "Residential Assessment Share": each Residential Unit's share of Residential <br /> Common Expenses as set forth in Exhibit "A", which percentage is based on the ratio of the <br /> square footage of the floor area of each Residential Unit to the total square footage of the floor <br /> area of all Residential Units. <br /> 1.74. "Residential Common Expenses": Those Common Expenses that are identified in <br /> and allocated solely to the Residential Units pursuant to Section 4.5.0 of this Declaration <br /> 1.75. "Residential Condominium": A Residential Unit and the interest in the Common <br /> Area that is appurtenant to that Residential Unit. <br /> 1.76. "Residential Unit": A Unit that is a Residential Unit that is shown and designated <br /> on the Condominium Plan as Unit <br /> 1.77. "Residential Unit Owner": The Owner of a Residential Unit. <br /> 1.78. "Residential Use Common Area": Those portions of the Project that are established <br /> under this Declaration for use by Residential Owners to the exclusion of Commercial Owners as <br /> set forth in Section 2.2.D. <br /> 1.79. Right to Repair Law": Division 2, Part 2, Title 7 (commencing with Section 895) <br /> of the Civil Code ("SB 800"). <br /> 1.80. "SB 800": The "Right to Repair Law". <br /> 1.81.
