Reference is made to the Association Budget for further detail regarding the <br /> particulars expenses in each category. <br /> (2)All Residential Common Expenses shall be divided equally among the <br /> Residential Unit Owners, except for those Residential Common Expenses that will be prorated as <br /> described below. Those Residential Common Expenses for items that are reasonably expected to <br /> provide certain Residential Unit Owners with benefits at least ten percent (10%) greater than other <br /> Residential Unit Owners with different sizes of Units shall be prorated according to the Residential <br /> Assessment Share. Those Residential Common Expenses that shall be prorated as described <br /> above shall be expenses for (i) utilities shared by the Residential Unit Owners (natural gas, water <br /> and sewer, refuse collection), (ii) HVAC systems that service the Residential Units and the <br /> Residential Use Areas except for the fan coil units located within the Residential Units, (iii) <br /> mechanical systems-water (circulation pump, water heaters, and (iv) mechanical systems-trash <br /> (trash chutes, trash chute doors). All Residential Common Expenses not prorated as described <br /> above shall be assessed to each Residential Unit Owner equally, notwithstanding a Residential <br /> Unit's Residential Assessment Share. The Association Budget provides greater detail regarding the <br /> prorated Residential Common Expenses. No Residential Common Expenses shall be assessed to <br /> the Commercial Unit Owners. <br /> (3) "Residential Common Expenses" shall include the costs and expenses <br /> of the Association for domestic water service furnished to the Residential Units, which shall be <br /> apportioned to the Residential Units by the Association based on the Residential Assessment <br /> Share or based upon the reading of submeters by the Association regarding such water service. <br /> The Association, or an agent engaged by the Association, may invoice for such water service to <br /> the Residential Units separately from the invoicing for other Assessments, based upon the reading <br /> of submeters. <br /> (4) Costs of water service to Residential Use Common Areas, including <br /> the Podium Area, shall be assessed as Residential Common Expenses to the Residential Units. <br /> (5) Residential Common Expenses shall include costs and expenses for <br /> the operations, maintenance, repair, and replacement of the Podium and Podium landscaping and <br /> other facilities and Improvements features or amenities situated on the Podium, the Podium <br /> surfaces and the concrete structure that constitutes the Podium and waterproof membranes. <br /> D. "Garage Expenses" are those expenses relating only to the maintenance, <br /> repair, cleaning or painting of the Garage and parking areas, allocations of Association insurance <br /> costs for Garage, capital improvements and reserves for Garage improvements, and related <br /> expenses. Garage Expenses are to be allocated and charged to those Residential Owners who <br /> have been assigned or licensed the use of a Parking Space as an appurtenance to their <br /> Residential Unit (as assigned or licensed under a Parking License Agreement) and to the <br /> Commercial Owners for the share of the use of Parking Spaces which are allocated, assigned and <br /> licensed to each of the Commercial Units. <br /> (1) Residential Units: The Association Budget provides an amount "per <br /> space" that shall be paid by each Owner with a parking space appurtenant to that Owner's Unit. <br /> Each Owner with a parking space appurtenant to that Owner's Unit shall pay the "per space" <br /> assessment for each parking space appurtenant to that Owner's Unit, Any Owner with more than <br /> one parking space appurtenant to that Owner's Unit shall pay a separate "per space" assessment <br /> for each parking space. Those Owners that do not have a parking space appurtenant to their Unit <br /> (if any) shall not be required to pay for maintenance, repair, cleaning or painting of the parking <br /> areas and related expenses. All accounting costs related to the parking areas shall be separated <br /> from the other accounting costs related to all Owners, and shall be paid only by those Owners with <br /> a parking area appurtenant to their Unit. Any such costs and expenses related to the parking areas <br /> shall be allocated in the Association budget as described above, Reference is made to the <br /> Association Budget for further detail concerning the parking related expenses and assessments. For <br /> any Parking Spaces that have not been assigned or licensed to a Residential Owner, the Garage <br /> Expenses for such Parking Spaces shall be allocated to the Declarant as long as Declarant has <br /> use of such Parking Spaces as provided in Section 2.4.K.
