7.1.F. - Page 114 <br /> C. Upon approval of the Board, the Commercial Owner shall diligently proceed <br /> with the commencement and completion of all work so approved by the Board in compliance with <br /> the approvals granted. Any work that requires such approval must be commenced within six <br /> months from the date of approval unless the Board permits the work to be commenced at a later <br /> time. If the work is not commenced within six months after the approval date, or such later time <br /> as the Board has granted approval, then the approval shall be deemed cancelled, and the Owner <br /> must reapply to the Board before undertaking any such work. <br /> D. No Commercial Owner may cause or permit any mechanics' lien to be filed <br /> against the Common Area or another Owner's Condominium for labor or materials alleged to have <br /> been furnished or delivered to the Commercial Owner. Any Commercial Owner who permits a <br /> mechanics' lien to be so filed shall cause the lien to be discharged within five (5) days after notice <br /> to the Commercial Owner from the Board. If the Commercial Owner fails to remove such <br /> mechanics' lien, the Board may discharge the lien and levy a Special Assessment against the <br /> violating Commercial Owner's Commercial Unit to recover the cost of discharge. <br /> E. All alterations, modifications, or other improvements within the Project <br /> undertaken by a Commercial Owner shall comply with all design requirements, approvals and <br /> procedures of the City. Before commencement of any alteration or improvements approved by the <br /> Board, the Commercial Owner shall comply with all appropriate governmental laws and regulations, <br /> including, but not limited to, payment of any fees and obtaining all permits required. Approval by <br /> the Board does not satisfy the appropriate approvals that may be required by any governmental <br /> entity with appropriate jurisdiction. <br /> F. In the event the Board fails to approve or disapprove plans and <br /> specifications in writing within thirty (30) days after the same have been submitted to it, approval <br /> will not be required and the related covenants shall be deemed to have been fully complied with. <br /> Approval of plans by the Board shall in no way make the Board or its members responsible for or <br /> liable for the improvements built after approval of the plans, and the Owner whose plans are <br /> approved shall defend, indemnify and hold the Board, the Association, and its members harmless <br /> from any and all liability arising out of such approval. <br /> G. The provisions of this Section 7.11 that pertain to the rights of or limitations <br /> upon Commercial Units shall not be amended with respect to Commercial Units without the vote or <br /> written consent of all of the Commercial Units. <br /> 7.12. Structural Integrity: Nothing may be done in any Condominium or in, on or to the <br /> Common Area that may impair the structural integrity (including the water seal) of any Building, or <br /> that may alter the plumbing, electricity or natural gas facilities serving any other Condominium, <br /> except as otherwise expressly provided in this Declaration. No Owner may pierce, drill or bore <br /> into, remove or otherwise modify any wall, ceiling or floor separating the Unit from another Unit or <br /> from Common Area (except as approved by the Architectural Control Committee), nor install any <br /> wall or ceiling-mounted loudspeakers or other noise-generating devices. The Board may adopt a <br /> Rule that restricts the hours of operation or otherwise restricts the use of jacuzzi-type tubs in the <br /> Units. <br /> 7.13. Window Coverings: All drapes, curtains, shutters, blinds or other window <br /> coverings for Residential Units that are visible from the street or Common Areas shall be beige, <br /> white, or off-white in color or lined in beige, white, or off-white, or as the case may be, of colors, <br /> materials and patterns which are approved by the Board or the Architectural Control Committee. <br /> No aluminum foil, paper or other temporary or unauthorized covering or treatments of windows of <br /> Residential Units shall be permitted. Window coverings for Commercial Units shall be limited to the <br /> type and extent of window coverings allowed by the City for ground floor commercial space. The <br /> provisions of this Section 7.13 shall not be amended with respect to Commercial Units without the <br /> vote or written consent of all of the Commercial Units. <br /> 7.14. Clothes Lines: There shall be no outside laundering or drying of clothes.
