7.1.F. - Page 115 <br /> 7.15. Power Equipment ATM's and Motor Vehicle Maintenance: <br /> A. No power equipment, hobby shops, or motor vehicle maintenance (other <br /> than emergency work) shall be permitted within the Project except with prior written approval of the <br /> Board (except for construction work being undertaken on a Unit that has been approved by the <br /> Board or Architectural Control Committee if such approval is required under this Declaration). <br /> Approval shall not be unreasonably withheld, and in deciding whether to grant approval, the Board <br /> shall consider the effects of noise, air pollution, dirt or grease, fire hazard, interference with radio <br /> or television reception, and similar objections. All hazardous waste shall be disposed of properly <br /> by each Owner. <br /> B. The use of equipment and machinery in Commercial Units shall not be <br /> subject to this Section 7.15, provided that the use of such equipment and machinery is ancillary to <br /> an allowed commercial use and that such use of equipment and machinery shall not materially <br /> interfere with the use and enjoyment of the Residential Units or Common Areas of the Project. The <br /> provisions of this Section 7.15 shall not be amended with respect to Commercial Units without the <br /> vote or written consent of all of the Commercial Units. <br /> C. ATM Installation: The Owner or Occupant of Commercial Unit A shall be <br /> entitled to install, at its expense, ATMs (automatic teller machines) in conjunction with the use of <br /> Commercial Unit A as a financial institution, in the location[s] shown on the Condominium Plan as <br /> the area[s] reserved for such ATM installation. The provisions of this Section 7.15.0 shall not be <br /> amended with respect to Commercial Units without the written consent of the Owner of Commercial <br /> Unit A. <br /> 7.16. Liability of Owners for Damage to Common Area: The Owner of each <br /> Condominium shall be liable to the Association for all damage to the Common Area or <br /> improvements caused by the Owner, or any Occupant for which the Owner is responsible, to the <br /> extent described in Section 5.1.A(2). <br /> 7.17. Commonly Metered Utilities: The Board may establish restrictions regarding the <br /> individual use of any utility on a common meter, and may impose reasonable charges for the <br /> individual use thereof. <br /> 7.18. Flags, Pennants, Banners, Etc.: <br /> A. There shall be no exhibiting, flying or hanging of any flags, pennants, <br /> banners, kites, towels, etc., from the Common Area or from any Residential Unit of the Project <br /> (except by Declarant during the period Declarant is marketing the Project) that would be visible <br /> from the street, Common Area, or the other Units, except in conformance with Rules adopted by <br /> the Board or the Architectural Control Committee, and except for flags, banners and signs that are <br /> expressly permitted by statute. The Association may adopt Rules regarding the display of flags, <br /> banners and signs from the Common Area or from any Residential Unit provided that such Rules <br /> shall be consistent with the then applicable laws. <br /> B. The use of flags, pennants, banners, and similar items by Commercial <br /> Owners shall be in accordance with then existing laws and regulations of the City and Section <br /> 7.2.B. The provisions of this Section 7.18 that pertain to the rights of or limitations upon <br /> Commercial Units shall not be amended with respect to Commercial Units without the vote or <br /> written consent of all of the Commercial Units. <br /> 7.19. Water Bed Restrictions: No water beds shall be permitted in the Project. <br /> 7.20. Activities Causing Increase in Insurance Rates: Nothing shall be done or kept in <br /> any Unit or in any improvements constructed in any Unit, or in the Common Area, which will <br /> increase any applicable rate of insurance or which will result in the cancellation of insurance on <br /> any Unit or any part of the Common Area, or which would be in violation of any law. <br /> 7.21. Common Area Use - Storage: Nothing shall be stored, grown, or displayed in the <br /> Common Area, including, without limitation, Exclusive Use Common Areas such as Balconies and <br /> Patios that is not approved in advance by the Architectural Control Committee. The Association <br /> may adopt Rules regarding the use of Balconies and Patios, including limiting or prohibiting storage <br /> of items thereon or use of barbeques and other items on Balconies and Patios.
