Concrete Slabs: Concrete slabs for the Project may be reinforced with grid of steel <br /> cable installed in the concrete slab and then tightened to extremely high tension ("Post Tension <br /> Slab"). Cutting into any Post Tension Slab in any building within the Project for any reason may be <br /> very hazardous and may result in serious damage to the Units or building and may elute personal <br /> injury. No Owner shall cut into or otherwise tamper with any Post Tension Slab or permit or allow <br /> any other Person to cut into or otherwise tamper with any Post Tension Slab. Each Owner shall <br /> disclose to any Person who rents, leases or purchases the Unit atom the Owner the existence of <br /> the Post Tension Slab and these limitations on cutting into or otherwise tampering with the Post <br /> Tension Slab. The Owner shall indemnify arid hold harmless Declarant, the Association and their <br /> officers, employees, contractors and agents from and against any and all claims, damages, losses <br /> or other liability (including attorneys' fees and costs of court) arising from any breach of this <br /> covenant by such Owner or the tenants or renters of, or purchasers from such Owner. No drilling <br /> or cutting whatsoever into the Post Tension Slab shall be permitted without the prior written <br /> approval of the Board, and any cutting or drilling into the Post Tension Slab shall require the <br /> review, approval and oversight of a structural engineer or similar licensed professional. <br /> 7.37. Right of Entry by Association: The Association has the right to enter each <br /> Condominium to inspect the Common Area and common elements of the Project, and may take <br /> whatever reasonable corrective action it determines to be necessary or proper. Entry onto any <br /> Condominium Unit under this Section 7.37 may be made after advance written notice (received by <br /> Owner pursuant to Section 9.10 not less than seventy-two (72) hours prior to entry, unless an <br /> emergency exists, in which case no written notice need be given). Notwithstanding the above, <br /> except in the event of an emergency, entry to the Commercial Unit or any individual commercial <br /> space therein shall be restricted as provided in Section 2.6.G or this Declaration. Any damage to <br /> the Condominium caused by entry under this subsection shall be repaired by the Association. The <br /> provisions of this Section 7.37 and of Section 2.6.G that pertain to the rights of or limitations upon <br /> Commercial Units shall not be amended with respect to Commercial Units without the vote or <br /> written consent of all of the Commercial Units. <br /> ARTICLE VIII. INSURANCE; DAMAGE OR DESTRUCTION; CONDEMNATION <br /> 8.11nsurance: The Association shall obtain and maintain the following insurance: <br /> A. Association Insurance: <br /> (1) A master property (hazard or casualty) policy insuring all <br /> improvements, equipment and fixtures in the Project (including the Units as originally constructed), <br /> including all built-in or set-in appliances, cabinets and floor coverings, in the amount designated by <br /> Declarant as the original replacement cost thereof based on the standard package of appliances, <br /> cabinets and floor coverings offered to all Owners before the Close of Escrow) with policy limits of <br /> 100% of the full replacement value of the covered improvements, excluding foundations, <br /> excavations and footings and other items usually excluded from such insurance or endorsements in <br /> form and content acceptable by FNMA, FHLMC or FHA and meeting such other requirements as <br /> set forth in subparagraph 8.1.B, below. The following endorsements should be included in any <br /> such property (hazard or casualty) hazard policy, if commercially reasonable to obtain: <br /> (a) changes in building codes ("ordinance or law <br /> endorsement"); <br /> (b) inflation guard coverage; <br /> (c) demolition coverage; <br /> (d) "agreed-amount" endorsement (to eliminate a coinsurance <br /> problem); <br /> (e) replacement cost endorsement; and, <br /> (f) primary coverage endorsement. <br /> (2) an occurrence version comprehensive general liability policy insuring <br /> the Association, its agents, the Owners and their respective family members, against liability <br /> incident to the ownership or use of the Common Area or any other Association owned or <br /> maintained real or personal property.
