CM shal! promptly notify the CITY in wr�ting af aD CM observed instances af <br /> Contrador's failure to camply with applicable safety requirements. If in the <br /> course of performing servic�s during the constructivn, the CM observes a <br /> safety violatian or othsr unsafg condition on or about the site or surrounding <br /> area which have an immediate or patential or actual adverse effect on life or <br /> property, the CM is autharized, without prior notice to the CITY or prior <br /> direetive by the CITY, to take all actions deemed necessary and appropriate <br /> by #he CM under the then existing circumstances to prevent such actual or <br /> potential adverse effect. <br /> h. CM shall became familiar with all CEQA documents and permit requirements <br /> from other agencies having jurisdictions over the site ar work that will affect the <br /> project and the construction site. CM shall be responsible far monitoring all <br /> aspects of the project as it r�elates to the requirements. CM shall monitar the <br /> Cont�actor's campliance with all �equirements of the CEQA documents and <br /> perrnits by other agencies. CM shall take prompt action appropriate under the <br /> circumstances, induding stapping the work and thereupon notifying the CiTY in <br /> writing if Contrador is not following all requirements. <br /> 6. Contract Change 4rder (CCO) processing, CM services shail include but are not <br /> limited to the fotlowing: <br /> a. Coordinate and disseminate correspondence, drawings and ather written <br /> materials by and between the Contractor, the CITY and the design cansultants <br /> relating to changes to the praject. CM will coordinate the Contractor's <br /> pe�formance of changes authorized by the CITY. CM shall maintain a lag ar <br /> other written records to monitor the pendency and dispasition of change and <br /> GC4s to keep the CITY acEvised of the status of the same and the actual or <br /> potential impact of any particular change or CCO or the cumulative effects <br /> thereof on the construdian cost or time for completion of canstruction of the <br /> project. � <br /> b. Assist the CITY and des�n consultant in evaluation of requests for the <br /> Contactor for issuance of CCOs, assist in negotiations with the Contractor <br /> relative to the CCOs proposals and the adjustment of the contract price ar the <br /> cantracf time under the construction contract. CM will make recomme�dations <br /> to the CITY and the design consultant for handfing and disposition of the <br /> Contractor's proposal relative to the ehanges. If a change to the construction <br /> contract is approved or authorized by the CITY, CM will assist the CITY and <br /> the design consultant in the preparatian of a CCO reflecting such approved or <br /> authorized change to the canstruction oontract. The CM is nat authorized, <br /> without the prior consent and approval of the CITY, to effectuate or authorize <br /> any change to the work of#he project. The CM shall be liable to the CITY for <br /> all direct and cansequen�al costs, losses or damage �esutting from the CM's <br /> direction or autharization to effectuate a change to the warlc of the project <br /> without the prior direction and authorization by the CITY. <br /> 7. Claims handling, CM service shall include but arc not limited to the following: <br /> a.
