CM wiii mainGain daily reaords during oonstruction of the project showing weathe� oonditions, personnel of the Contractor and Subcorrtractor at the site, work accomplished, prablems encountere,d and other matters materiaily affecting the project, camptetion of the project or canstruction cost to complete constn�ction of the project. CM shall maintain project reoards for test results and speciai inspection resuits. b. Provide monthly progress reports on the project. 5. Site observations of project, CM services shail include but are not limited to the following: a. CM shall be on-site during canstruction of the project and substantially at ali times during which there are conshuction activities at the site. CITY and CM may agree ta the amaunt of time required to be at the site for observation, however this does not relieve the CM from the requirement of having knowtedge af the status of the wo�ic. b. C�ordinate testing, lab services and inspections, this includes by outside firms. CM will wo�lc with the Building Department for permit inspections coordination and final approvals of permit. Provide testing and test resuits by testing finn aeceptabie to CITY. Such testing services shall be a reimbursable expense as described in Task 5. c. Maintain at the site #he following documents at a minimum: Contra�t, Drawings, Spec�cations, approved Change Orders, Submittals, building permit, SWPPP and assaciated testing o� monitaring dacumentation, other permits, applicable codes, rules and regulation and other written or electronic materials relating to the project. d. CM will endeavor to guard the CITY against defects and deficiencies in construction and workmanship of the project on the basis of its site observations, and a quality control program established and implemented hereunder to monitor canstnaction woricmanship for conformity: 1) accepted indusiry standards; 2) applicable laws, codes, regulatians, ordinances or rutes: 3)and the requirernents of the construction documents. e. CM shaU reject work whenever in the ordinary course of discharging its services the CM discovers or observes patent conditions of defective or � deficient construction and warkmanship which as or may have an adverse impact upon the project's life-safety systems or aperations, structural elements or integrity of the safety of persons or property. CM shall take prampt action appropriate under the circumstances, incfuding stopping the work and thereupon notifying the CITY in writing. CM's responsibilities hereunder shall be limited ta defective or defiaent work or an apparent or patent nature. f. Review the Contactor safety program and the requirements of the canstruction documents and applicable law. CM shall monitor the Contracto�'s c:ampliance with safety programs and advise the CtTY of ineasures, if any, nevessary or appropriate to obtain the Contractw"s compliance. By undertaking the obligatian hereunder, CM shall not be deemed to have assumed responsibility of the adequacy or suff'�ciency of safety programs implemented by the Gantractor, but the CM is responsible for verifying that the Contractor has REV:04-06-IS ML6 Page 8 of 10 ATTY/AGR.Amend No. 11Gilbane Building Company
