7.1.B. - Page 37 <br /> Jerry Pierce, a member of BIAC, said he is speaking as a community member in being <br /> aware of the needs of the community, especially as it pertains to parks. He is excited <br /> about the Inner Harbor Plan. He spoke about being a proud resident and mentioned <br /> Redwood Shores, Bair Island, the Inner Harbor Specific Plan, and having a defined <br /> regional and community space for recreation that combines parks, playing fields and <br /> water access. <br /> Reid Boggiano, a Public Land Management Specialist representing the State Lands <br /> Commission, addressed the comments contained in the May 12th Staff report to City <br /> Council about the city's pursuit of possible legislative remedies for residential uses on <br /> the public trust lands granted to the city. He said the legislature has granted to the City <br /> the control and management over the public trust lands underlying Docktown and the <br /> State Lands Commission is vested in residual oversight of the property and is <br /> responsible for ensuring that local trustees are complying with the public trust and <br /> statutes. In a letter from the Commission Staff that was sent to the City on February 25, <br /> 2014, they explained their stance, that based on advice from the Attorney General's <br /> Office on sovereign lands such as those underlying this floating home community, this <br /> residential use only benefits a select few rather than the statewide public, it is not water <br /> dependent, and it impairs public access to and enjoyment of sovereign lands. He <br /> further stated that the Commission looks forward to continuing working with the City on <br /> its obligations over the granted lands and that it is used in accordance with the terms of <br /> the granting statute and the public trust. <br /> Annette Kirkham, an attorney with ICW Foundation of Silicon Valley, said she is <br /> representing Redwood Creek Association and is a Docktown resident. She said the <br /> City cannot afford to lose more affordable housing. She said the City has not met its <br /> State mandated obligations for low and moderate income housing and opined that the <br /> City should do whatever it can to help and to seek grandfathering in residents in that <br /> area with the State Lands Commission. <br /> Gita Dev is concerned about the wetlands and the Ferrari site often being shown as <br /> developed. She also concurs with Council Member Pierce on combining Open Space, <br /> so that the areas marked for new development would be a consolidated public <br /> recreation area. She would like to see alternatives for the EIR and what the implications <br /> would be. <br /> The Mayor concluded the public comment and opened the floor for Council direction. <br /> He reiterated what Assistant City Manager Ekern had said on what the Council direction <br /> should be on deciding the uses of the land and water areas. A Council Member <br /> thanked the Task Force and Staff for the commitment. He mentioned the past <br /> processes like the Downtown Precise Plan. He agrees with Mr. Ekern that they just <br /> need to define the next step, not the end point. <br /> This same Council Member mentioned the categories that apply to his thoughts on the <br /> Plan: <br /> • Commercial Development and FAR (floor area ratio) <br /> • Density for Residential Development <br /> • Open Space 33% and include the water and private partnership opportunities <br /> CITY COUNCIL May 12, 2014 <br /> MEETING MINUTES PAGE 15 <br />
