ATTACHMENT 1 <br /> 7.1.A. - Page 11 <br /> TENTATIVE AGREEMENT BETWEEN <br /> REDWOOD CITY AND <br /> CHIEF OFFICERS' ASSOCIATION (COA) <br /> RE: SUCCESSOR MOU <br /> 11.1.10 Disorderly or immoral conduct; <br /> 11.1.11 Incapacity due to mental or physical disability; <br /> 11.1.12 Neglect of duty. <br /> 11.3 Any discharged, suspended or demoted employee, or an employee who has had his/her <br /> pay reduced, shall be furnished, in advance of the disciplinary action, a written Notice of <br /> Intent to Disc_ipline listing the reasons for the disciplinary action. The employee subject <br /> to discipline shall be provided the opportunity for pre-disciplinary due process. A and a <br /> copy of this letter shall be furnished to the Association at the employee's request. <br /> 11.4 Probationary employees may be discharged for any reason which, in the sole opinion of <br /> the City, is just and sufficient, and such discharge shall not be subject to the grievance <br /> procedure set forth in Article 19, except that regular employees of the City who are <br /> serving a probationary period for a promotional appointment shall be subject to dismissal <br /> only pursuant to the provisions of Articles 9.5 (Rejection of Probationer), 11.1 <br /> (Discipline), 11.2 (Discipline), and 11.3 (Discipline), who are serving a subsequent <br /> Article 13: Retirement <br /> 13.1 The City shall contribute on behalf of members of the COA unit seven percent (7%) <br /> member contribution to the retirement plan in addition to the established employer <br /> contribution and the employee will contribute the additional 2% member contribution on <br /> a pre tax basis. The 7% contribution shall be added to the eligible compensation for <br /> establishing special compensation under California Public Employees Retirement—System- <br /> rules (PERS section 20023(c)(4). SEE LANGUAGE ABOVE. <br /> 13.12 Tier One: For COA unit members hired prior to the 2011 amendment of the City's- <br /> contract with CalPERSOctober 24, 2011, retirement benefits shall be those established by <br /> the Public Employees' Retirement System (PERS) for Local Safety Members three <br /> percent (3%) at fifty (50) formula. Retirement benefits for Tier One COA unit members <br /> will be calculated based on one (1) year highest compensation PERS retirement benefit, <br /> as authorized by Section 20042 of the Government Code. <br /> 13.2 Tier Two: For COA unit members hired on or after the 2011 amendment of the City's <br /> contract with CalPERSOctober 24, 2011 and who are considered "classic members" by <br /> Ca1PERS, retirement benefits will be those established by Ca1PERS for Local Safety <br /> Members, three percent (3%) at age fifty-five (55) formula.
