(e) Permittee shall not make, or cause to be made, nor allow to be made, <br /> alterations or improvements to the Permit Area. If,at any time, any of Permittee's activities <br /> conducted pursuant to this Permit cause any damage to any portion of the City property <br /> or facilities, Permittee will promptly repair such damage to City's satisfaction. <br /> (fl Upon the termination or revocation of this Permit, Permittee shall restore the <br /> Permit Area and any City facilities to the then-current City standards. <br /> 3. Citv's Access. City reserves the right to unlimited access to the Permit Area, or <br /> any part thereof for municipal purposes, including, but not limited to, the performance of <br /> maintenance and repairs of any and all structures,facilities or public improvements heretofore or <br /> hereafter installed and/or constructed in or upon the Permit Area, the inspection of the right-of- <br /> way, the use, maintenance, repair of adjoining areas or for any other purpose in furtherance of <br /> City's use of the Permit Area. City shall not be obligated to repair, replace or maintain any signs <br /> installed by the Permittee in the case that damages are caused by any parties other than the City. <br /> Permittee acknowledges and agrees that should the City wish to remove the Signs from the <br /> infrastructure, facilities or structures on which the Signs are installed for any reason, it has the <br /> authority and right to do so. If and when the City chooses to replace or upgrade the infrastructure <br /> supporting the Signs installed by Permittee, Permittee shall be responsible for the reinstallation <br /> of such Signs. If the City chooses to relocate infrastructures that support the Signs, and Permittee <br /> desires to install signs on the relocated facilities, Permittee must apply for a new Sign <br /> Encroachment Permit to cover such new sign installation, maintenance and replacement. <br /> 4. Waiver of Claims. Permittee, on behalf of itself and all of its agents associated <br /> with this Permit, waives all claims against the City, its Council, officers, boards, commissions, <br /> agents, employees and volunteers for any damage to Permittee's Signs or any components to <br /> the Signs in, upon or about the Permit Area, and for injuries to any employees of Permittee, its <br /> officers, agents, contactors, or volunteers. <br /> ATTY/AGR/2014.078/REVOCABLE ENCROACHMENT PERMIT KAISER <br /> REV:05-28-14 VR <br /> Page 3 of 8 <br />
