ATTACHMENT 1 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: Section 1. The Planning Commission finds that the above recitals are accurate and constitute findings in this matter and, together with the Staff Report and the application materials, including without limitation the Initial Study (IS), development plans, and all other documents, reports, studies, memoranda, maps, oral and written testimony, and materials in the City's file for the applications and the Project, and all adopted City planning documents relating to the Project and the property including the City's General Plan, Municipal Code, Peninsula Park Precise Plan, the Marina Shores Village EIR, Addendum Nos. 1 and 2 and other applicable City laws and regulations, and all associated approved and certified environmental documents, have together served as an adequate and appropriate evidentiary basis for the findings and actions set forth in this Resolution. Section 2. CEQA: The Planning Commission finds that a. The IS was prepared in accordance with all legal requirements. b. The Planning Commission has reviewed and analyzed the IS and other information in the entire record and has considered the information contained therein, including the written and oral comments received at the public hearing on the Project, prior to acting upon or approving the Project. c. Based on substantial evidence in the record, the proposed Project is within the scope of the previously approved Peninsula Park Precise Plan and is adequately described in the previously certified ER and Addendum No. 1 for purposes of CEQA. The mitigation measures and Statement of Overriding Considerations associated with certification of the Project EIR addresses the environmental effects of the currently proposed Project. Accordingly, with the approval of this Project, all applicable mitigation measures and the Statement of Overriding Considerations are hereby reconfirmed and readopted. d. As set forth in CEQA Guidelines sections 15162 and 15168, the proposed Project will not result in any new environmental effects or require new mitigation measures beyond those identified in the EIR and Addendum No. 1 and adopted upon approval of the Peninsula Park Precise Plan. No new environmental document is required. e. Pursuant to Guidelines section 15091(e), the documents and other materials that constitute the record of proceedings upon ATTY/RESO.2982/PC ONE MARINA HOTEL-650 BAIR ISLAND ROAD REV:05-29-14 VR Page 2 of 9
