ATTACHMENT 1 <br /> NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: <br /> Section 1. The Planning Commission finds that the above recitals are <br /> accurate and constitute findings in this matter and, together with the Staff Report and <br /> the application materials, including without limitation the Initial Study (IS), <br /> development plans, and all other documents, reports, studies, memoranda, maps, <br /> oral and written testimony, and materials in the City's file for the applications and the <br /> Project, and all adopted City planning documents relating to the Project and the <br /> property including the City's General Plan, Municipal Code, Peninsula Park Precise <br /> Plan, the Marina Shores Village EIR, Addendum Nos. 1 and 2 and other applicable <br /> City laws and regulations, and all associated approved and certified environmental <br /> documents, have together served as an adequate and appropriate evidentiary basis <br /> for the findings and actions set forth in this Resolution. <br /> Section 2. CEQA: The Planning Commission finds that <br /> a. The IS was prepared in accordance with all legal requirements. <br /> b. The Planning Commission has reviewed and analyzed the IS <br /> and other information in the entire record and has <br /> considered the information contained therein, including the <br /> written and oral comments received at the public hearing on the <br /> Project, prior to acting upon or approving the Project. <br /> c. Based on substantial evidence in the record, the proposed <br /> Project is within the scope of the previously approved <br /> Peninsula Park Precise Plan and is adequately described in the <br /> previously certified ER and Addendum No. 1 for purposes of <br /> CEQA. The mitigation measures and Statement of Overriding <br /> Considerations associated with certification of the Project EIR <br /> addresses the environmental effects of the currently proposed <br /> Project. Accordingly, with the approval of this Project, all <br /> applicable mitigation measures and the Statement of <br /> Overriding Considerations are hereby reconfirmed and <br /> readopted. <br /> d. As set forth in CEQA Guidelines sections 15162 and 15168, <br /> the proposed Project will not result in any new environmental <br /> effects or require new mitigation measures beyond those <br /> identified in the EIR and Addendum No. 1 and adopted upon <br /> approval of the Peninsula Park Precise Plan. No new <br /> environmental document is required. <br /> e.
