Candidate James Lee Han was also informed that if the funds <br /> were not received by a certain date the matter would be placed before the City Council <br /> for a policy decision. To the best of City Staff's knowledge, there is no established <br /> precedent on how to address this situation, since in recent history the City has not <br /> encountered a similar situation. To date no response has been received by the <br /> candidate and it is possible that Mr. Han may be out of the area. <br /> The San Mateo County Elections Office has not been paid the amount owed. As of now <br /> 90-days have elapsed, and the City Clerk is seeking City Council direction for these <br /> additional reasons: <br /> ➢ Council established clear policy, via Resolution No. 15269, related to candidates <br /> paying for their own statements (regardless of being successful or unsuccessful); <br /> ➢ Transparency and fairness in the process since five other candidates were asked <br /> to pay for the owed amounts and paid. <br /> ➢ The City Council is the body that should decide if it wants to set a precedent by <br /> covering the owed amount for a candidate statement. <br /> ALTERNATIVES <br /> The City Council could turn the matter over to a collections agency which would then <br /> charge 25% on total amount to be collected.
