7.1.L. - Page 67 <br /> The Association shall maintain and repair all lateral lines and equipment located within Association <br /> Property that exclusively serve a Condominium even if connected with equipment that serves two or more <br /> Condominiums, provided that the Owner of the Condominium served by the lines and equipment shall pay all <br /> maintenance and repair costs incurred by the Association and the Association may level a reimbursement <br /> assessment against the Owner's Condominium to collect payment. <br /> Each Owner shall maintain the Exclusive Use Common Area appurtenant to the Owner's <br /> Condominium in a neat, clean and sanitary condition at all times. Each Owner shall maintain, repair and <br /> replace the Owner's individual garage door and garage door openers in the Exclusive Use Common Area <br /> individual garages appurtenant to the Owner's Unit, provided that the Association shall be responsible for the <br /> periodic repainting of the exterior surface of the individual garage doors. <br /> Each Owner shall be responsible for maintaining and repairing the HVAC system that exclusively <br /> serves the Unit. Owners are to maintain and replace the filters installed in the HVAC system to reduce <br /> exposure to pollutants in accord with the City's Green Building Ordinance. No Owner shall excavate,alter or <br /> otherwise disturb any Improvement or landscaping within any Association Property, including the podium <br /> adjacent to the Unit, without the prior written consent of the Board. The Board may require the Owner to <br /> comply with such terms and conditions as the Board may direct prior to commencement of any work within <br /> any Association Property. <br /> The Association shall inspect, maintain, repair, and replace the area drains and underground storm <br /> drain pipes located within the Exclusive Use Common Area patio appurtenant to the Owner's Condominium. <br /> Each Owner shall keep area drains within the Owner's Exclusive Use Common Area free and clear of debris <br /> at all times. <br /> Each Owner shall be responsible for maintaining any waterproof membrane or similar membrane on <br /> the Owner's deck surfaces. Maintenance must include periodic inspection of the deck surface for evidence of <br /> leaks and the immediate repair of any patio or deck surface that is damaged or penetrated in any manner. <br /> Owner must take appropriate precautions to prevent the membrane from being penetrated by sharp objects. <br /> In order to reduce the potential for water damage(including mold growth)within the Unit,each Owner <br /> shall perform each of the following steps: (i) periodically inspect the Unit for water leaks, other evidence of <br /> water intrusion (such as condensation on the windows or walls,water stains or other types of water damage) <br /> and for the presence of molds, fungi and their spores (collectively "Mold"); (ii) if any water leaks, water <br /> intrusion and/or Mold are detected, immediately take appropriate corrective steps to repair the leak and/or <br /> reduce water intrusion and repair any resulting water damage (including the removal of any Mold); <br /> (iii) maintain proper ventilation (particularly in the bathrooms)and humidity levels to reduce the risk of water <br /> damage (including Mold growth); (iv) periodically inspect refrigerator condensation pans, air conditioners (if <br /> applicable)and any other water-retaining appliances to ensure they are properly functioning and not leaking <br /> water or otherwise creating water damage to the Unit (including Mold growth); (v) periodically inspect <br /> carpeting or similar types of floor covering in bathrooms that may be conducive to Mold growth; (vi) replace <br /> heating and air conditioning filters not less frequently than quarterly or as recommended by the manufacturer; <br /> and (vii)take such other prudent steps as may be appropriate to prevent water leaks and water intrusion and <br /> to repair all leaks, sources of water intrusion and water damage (including Mold growth)within the Unit. <br /> In addition to the foregoing, each Owner shall comply with each of the following in performing the <br /> Owner's maintenance obligations: (i)the Guidelines described in Section 4.6 and (ii) commonly-accepted <br /> homeowners' maintenance obligations. <br /> Each Owner shall allow agents of the Association access to the Owner's Unit and Exclusive Use <br /> Common Area appurtenant to the Owner's Condominium for purposes of performing any of the Association's <br /> inspection, maintenance and repair obligations under this Declaration. If any Owner fails or refuses to provide <br /> access,the Owner shall be responsible for any maintenance and repair costs that could have been avoided if <br /> access had been provided, and the Association may levy a reimbursement assessment against the <br /> Condominium to recover the additional costs. <br /> CLSS\51643\927586.5 13 June 16,2014 <br />
