MEMORANDUM FROM THE CITY ATTORNEY <br /> CONCERNING A CLOSED SESSION BEFORE <br /> THE CITY COUNCIL OF THE CITY OF REDWOOD CITY <br /> TO: Honorable Mayor and Members of the City Council <br /> FROM: Pamela Thompson, City Attorney <br /> SUBJECT: CONFERENCE WITH LEGAL COUNSEL—EXISTING LITIGATION <br /> Litigation, to which the city is a party, has been initiated formally. [Gov't Code § 54956.9(d) (1)1. <br /> Friends of Cordilleras Creek and Finger Avenue Pride Committee v, City of <br /> Redwood City, Real Parties in Interest <br /> Superior Court of California, County of San Mateo <br /> Case No. CIV 517288 <br /> A closed session will be held on June 23, 2014, at 6:00 p.m., for the purpose of conferring with <br /> and/or receiving advice from your legal counsel concerning existing litigation. [Cal. Gov't Code <br /> section 54956.9(g)] <br /> After the closed session the legislative body of the local agency shall reconvene into open session <br /> and publicly report the following information: <br /> 1. Any action taken in the closed session; <br /> 2. The vote or abstention on each action of every member present; and <br /> 3. approval given to legal counsel to defend, or seek or refrain from seeking appellate <br /> review or relief, or to enter as an amicus curiae in any form of litigation as the result <br /> of a consultation under Section 54956.9. The report shall provide the adverse <br /> parties and the substance of the litigation, if known. <br /> [Cal. Gov't Code section 54957.1(a) (2)] <br /> The City shall publicly report approval given to its legal counsel of a settlement of pending litigation <br /> as defined in Section 54956.9, at any stage prior to or during a judicial or quasi-judicial proceeding <br /> after the settlement is final. The information shall be reported as follows: <br /> 1. If the legislative body accepts a settlement offer signed by the opposing party, the body <br /> shall report its acceptance and identify the substance of the agreement in the open <br /> session at the public meeting during which the closed session is held. <br /> 2. If final approval rests with some other party to the litigation or with the court then as soon <br /> as the settlement becomes final, and upon inquiry by any person, the local agency shall <br /> disclose the fact of that approval, and identify the substance of the agreement. <br /> [Cal.
