7.3.D. - Page 1 <br /> REPORT <br /> To the Honorable Mayor and City Council <br /> From the City Manager <br /> June 23, 2014 <br /> SUBJECT <br /> Purchase of heating, ventilation, and air conditioning (HVAC) equipment for the Fair <br /> Oaks Community Center at 2600 Middlefield Road <br /> RECOMMENDATION <br /> 1. By motion on the affirmative votes of at least five (5) members of the Council, <br /> pursuant to Municipal Code Section 2.76, find that strict compliance with Municipal <br /> Code Article VII, Chapter 2 does not serve the public interest in this instance, and <br /> suspend the competitive bidding requirements for equipment purchases. <br /> 2. Approve the sole source purchase of TRANE HVAC equipment from TRANE for an <br /> amount not to exceed $115,352.00 and authorize the City Manager to execute same <br /> agreement. <br /> BACKGROUND <br /> On December 10, 2007, Council approved Resolution No. 14825 which authorized the <br /> sole source purchase of TRANE HVAC equipment and suspended the requirements of <br /> Article VII, PURCHASING, Chapter 2 of the Municipal Code for the Main Library project. <br /> Staff is seeking similar authorization for the replacement of HVAC equipment and <br /> controls at Fair Oaks Community Center at 2600 Middlefield Road which have reached <br /> the end of their useful life. The project consists of removing and replacing two (2) <br /> rooftop HVAC units, installation of a third rooftop HVAC unit to supply heating and <br /> ventilation to the classroom, varitrac components, electrical work, seismic supports, <br /> control panel and installation of zone dampers to better control and improve energy <br /> savings. <br /> ANALYSIS <br /> Staff requests Council suspend the competitive bidding requirement to allow for the <br /> purchase of replacement HVAC units from the same manufacturer as the existing units. <br /> Staff wishes to purchase new units from the same manufacturer because of the existing <br /> control system and installation mounts are compatible and can be used rather than <br /> replaced. Modifying or replacing existing controls and mounts to accommodate <br /> equipment other than TRANE, would create delays and significantly increase the cost of <br /> this project without adding value. <br /> The City continues to install TRANE units at other City facilities. The increased <br /> standardization of HVAC equipment throughout the City makes repair and maintenance <br />
