In connoetion with its devolopment of the Proporty as a residential community, the <br /> Developer submitted to the City Improvement Pl�n,s for Cmystar—Redwood City 137, which include, <br /> inter alia, landscaping plans for aloag the Property frontage ("Plans"), all of which Plans l�ve becn <br /> approved by the City. The Plans provide for ins�ttallation of certain landscaping,pedestrian lightiag, and <br /> irrig�tion ("Improvcments") within Wilson Stnet, El Camiao Re�l, �nd Diller Street ("Maintenance <br /> Area'�as the Improvtmcnts and Maiatenance Area are more specifically shown on Exhibit"B"attached <br /> hereto and by this referenco made a part hereof. <br /> C. Tho Devoloper has submitted a parecl map for the Property,which has been reviewed by <br /> the City Engineer and is being approved concusrently with this Agreement("Fina1 Map"). <br /> D. The Develop�r rocognius that the City's approval of the Final Map is based on the <br /> Developer's commitment to the long-term maintenance, repair, care and, if and when necessary, <br /> replacement of the Improvoments, and that the Final Map would not have becn approved without the <br /> assurance that this Agreement wauld be executed by the Developer. <br /> E.
