ORIGINAL <br /> Healthy <br /> Schools <br /> Initiative <br /> Sequoia Healthcare District <br /> Sequoia Healthcare District <br /> MEMORANDUM OF UNDERSTANDING <br /> FY2016-17 (Year 5) <br /> I. Parties <br /> The City of Redwood City, charter city and Municipal Corporation of the State of California, ("CITY") will <br /> participate in this Memorandum of Understanding (MOU) with Sequoia Healthcare District, a governmental <br /> entity in Redwood City, California, ("SHD"). <br /> II. Intent <br /> A critical need exists for consistent physical education and physical activity opportunities for students <br /> during the school day. By increasing physical activity during the school day, along with positive and <br /> consistent health messages, it is anticipated that students will have greater physical fitness, improved self- <br /> esteem, lower levels of anxiety and stress, an increased sense of wellbeing, and improved academic <br /> achievement. SHD wishes to provide funding for CiTY to provide a program to the Redwood City School <br /> District ("RCSD") to assure that children in the RCSD have access to physical education opportunities and <br /> the benefits attendant thereto. It is intended that the CITY program curriculum will follow the PE+ Program. <br /> In setting forth the goals and mutual objectives of the parties to this Agreement, SHD and CITY recognize <br /> that RCSD is not a party to this Agreement and that the CITY's program funded by SHD cannot be carried <br /> out absent RCSD's cooperation and implementation of the program. RCSD is not a party to this Agreement <br /> and in order to effectuate this Agreement, RCSD would need to agree to the continued delivery of this <br /> program and this agreement with CITY. <br /> ili Term of Agreement; Termination of Agreement <br /> A. The term of this Agreement commences July 1 , 2016 and ends on June 30, 2017 unless <br /> terminated as set forth below. <br /> B. Termination <br /> 1 . SHD. SHD intends to fund an annual grant to CITY beginning July 1 , 2016 and ending June 30, <br /> 2017. SHD may reduce or eliminate the intended funding if a) SHD's Directors decline to <br /> collect property taxes in the funding cycle, (b) a significant portion of SHD's property tax <br /> revenues are borrowed or otherwise taken by the State of California, (c) SHD's Directors <br /> discontinue the allocation of funding to the Healthy Schools Initiative Program, or (d) CiTY fails <br /> to fund positions or programming described in this MOU or fails to substantially comply with its <br /> obligations under this MOU. <br /> Page 1 of 8 <br /> REV: 09-28-16 RL <br /> ATTY/AGR.20I6.084/Sequoia Healthcare District <br />
