McKendry <br />PUBLIC HEARING, Appeal of C. W. Lebsack on behalf of William Kennett, M. D. and Gloria <br />Kennett from denial by the Planning Commission on their application for a variance <br />to Section 10.9(c), Ordinance 1130, to permit a rear yard depth of 6 feet where a <br />depth of 15 feet is required; to Section 30.15(c), Ordinance 1130, to permit required <br />parking spaces to extend into the street side yard of a corner lot; and to Section <br />30.24(d), Ordinance 1130, to permit a reduction to 23 parking spaces where 26 spaces <br />are required, in an R-5-0 District, at 1103 Hopkins Avenue (Lot 1, Block 6, Redwood <br />Highlands), declared open and affidavits of publication and mailing ordered filed. <br />Report of Planning Commission read, stating Planning Commission held a public hearing <br />on above application at meeting of June 28th and motion to grant variance lost for <br />lack of a second. Absence of action to grant was declared to be as an action to deny. <br />Report of Staff Analysis stated applicant owns two adjacent lots with an existing <br />apartment extending approximately 3 feet over the dividing property line. Applicant <br />proposed to remove portion of apartment and construct medical clinic on corner lot. <br />There are also four other single family dwellings on this parcel. Report further <br />described the site as containing four completely substandard garages. Applicant <br />proposes to retain buildings until some indefinite future date, at which time he <br />proposes to demolish complex and expand his medical clinic onto this lot also. <br />Approving construction as proposed would be giving tacit approval to several existing <br />nonconforming conditions on interior lot: <br />1. Distance between buildings less than 10 feet. <br />2. Four dwellings with 4 -foot side yards. <br />3. One dwelling with no side yard on one end; the other end with a <br />216" side yard, and a rear yard depth of 4 feet. <br />4. More than 40% coverage of required rear yard. <br />5. Completely inadequate parking, since the four garage spaces are for <br />below standard size. <br />
