<br /> ORIGINAL <br /> AGREEMENT <br /> FOR <br />CONSTRUCTION OF IMPROVEMENTS <br /> 1250 JEFFERSON AVENUE <br />THIS AGREEMENT, made and entered into this ~ day of ~,2004, by <br />and between the CITY OF REDWOOD CITY, a charter city and municipal corporation of the State <br />of California ("City"), and WHOLE FOODS MARKET NORTHERN PACIFIC, a California <br />corporation, and the Developer of said real property located at 1250 Jefferson Avenue, Redwood <br />City, California ("Developer"). <br /> WITNESSETH: <br />WHEREAS, Developer proposes to construct certain real property improvements at 1250 <br />Jefferson Avenue (the "Property"), situated in the City of Redwood City, County of San Mateo, <br />State of California, consisting of a parking lot and a retail/commercial building; and <br />WHEREAS, Developer has requested that construction of certain Improvements (as <br />defined below), be constructer:! at the Property, which improvements are to be constructed in <br />accordance with, and as required by, the plans, specifications, and details hereinafter described. <br />NOW, THEREFORE, in order to ensure satisfactory performance by Developer of <br />Developer's obligations under Article VII, Chapter 29, General Street Improvements, of the Code <br />of the City of Redwood City, and in consideration of the approval of the Improvements for the <br />Property, the parties hereto agree as follows: <br />1. ImDrovements. Developer shall, at its own cost and expense, construct all of the <br />improvements (the "Improvements"), furnish all the materials, and do all the work hereinafter <br />described in accordance with, and as provided for in, the plans prepared for Developer by BKF <br />Engineers, Surveyors & Planners, entitled "Plans for the Street Improvements at 1250 Jefferson <br />Avenue," as well as City's revised specifications entitled "Engineering Standards of the City of <br /> 1 <br /> -~" - rHO <br />
