<br /> DES:d:F" 3/22/94 (022/36) <br /> o RIG I N A L 3/28/94 <br /> RESOLUTION NO. 12157 <br /> <br /> ---------- <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br /> AMENDMENT TO JOINT EXERCISE OF POWERS AGREEMENT - SOUTH <br /> BAYS IDE TRANSFER STATION AUTHORITY <br /> WHEREAS, pursuant to Resolution No. 8932, adopted August 10, <br /> 1981, the City of Redwood City, together with certain other <br /> public agencies in the County of San Mateo, entered into that <br /> certain Joint Exercise of Powers Agreement (the "Agreement") <br /> establishing the South Bayside Transfer Station Authority (the <br /> "SBTSA") to, among other matters, facilitate the collection and <br /> disposal of solid waste; and <br /> WHEREAS, the parties to the Agreement are required to <br /> reduce, recycle and reuse solid waste generated within their <br /> respective jurisdictions and to provide services in connection <br /> therewith including waste source reduction, recycling, and <br /> composing activities; and <br /> WHEREAS, Browning-Ferris Industries of California, Inc. , <br /> ("BFI") currently owns and operates a solid waste transfer <br /> station constructed pursuant to agreement between SBTSA and BFI, <br /> and <br /> WHEREAS, BFI proposes to construct and operate a recycling <br /> facility at the transfer station which will process recyclables <br /> and enable the member agencies of the Authority meet their <br /> respective obligations for the diversion of solid waste pursuant <br /> to the Waste Diversion requirements (Pub. Res. Code §41780, et <br /> s eq. ) , of the California Integrated Waste Management Act of 1989 <br /> (Pub. Res.
