<br />DU PLICATE <br />ORIGINAL <br /> <br />Ot371.S4 <br /> <br />AGREEMENT BETWEEN THE EDGEWOOD SEWER MAINTENANCE DISTRICT AND <br />THE CITY OF REDWOOD CITY CONCERNING OPERATION, MAINTENANCE AND <br />TREATMENT OF SEW AGE. <br /> <br />day Of~//ZU=;¡ <br />("Effective Date"), by and between the Edgewood Sewer Maintenance District, a Sewer <br /> <br />THIS AGREEMENT, entered into this lid <br /> <br />, 2004 <br /> <br />Maintenance District of the County of San Mateo, State of Califomia, hereinô.ftcr c~Jled <br /> <br />"District," and the City of Redwood City, a municipal corporation, hereinafter called "City" <br /> <br />(collectively the "Parties") <br /> <br />WITNESSETH <br /> <br />WHEREAS, City is a party to that certain joint exerCIse of powers agreement, <br /> <br />establishing the South Bayside System Authority ("SBSA"), a public entity which currently <br /> <br />provides sanitary sewerage transmission and disposal services to the City and other constituent <br /> <br />agencies of SBSA; and <br /> <br />WHEREAS, District will own and operate sanitary sewage facilities ("District <br /> <br />Facilities") in unincorporated San Mateo County along Edgewood Road as described in Exhibit <br /> <br />A and as shown on Exhibit B, both attached hereto and incorporated herein by reference; and <br /> <br />WHEREAS, said SBSA has constructed, operates and maintains sanitary sewage <br /> <br />facilities ("SBSA Facilities") to serve its service area, which includes the land within the <br /> <br />District; and <br /> <br />WHEREAS, construction of the SBSA Facilities has been funded by Federal and State <br /> <br />grants, together with local public funds; and <br /> <br />WHEREAS, the City, has enacted certain uniform sanitary sewerage ordinances <br /> <br />("Uniform Ordinances") as contained in Chapter 27 of the City Municipal Code (as that chapter <br /> <br />- 1 - <br /> <br />0671.54 <br />
