<br />DES:djk lr11l/93 <br /> <br />(002/37) <br /> <br />0 RIG I N A L <br /> <br />10/25/93 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />12088 <br /> <br />---------- <br /> <br />RESOLUTION APPROVING AND AUTHORIZING APPLICATION FOR <br />CERTIFICATION FOR THE REGULATION OF CABLE TELEVISION <br />RATES FOR BASIC SERVICE AND RELATED EQUIPMENT; AND <br />DELEGATING CERTAIN DUTIES AND RESPONSIBILITIES TO THE <br />SAN MATEO COUNTY CABLE TELEVISION AUTHORITY IN <br />CONNECTION THEREWITH <br /> <br />WHEREAS, the City of Redwood City has granted a franchise to <br /> <br />operate <br /> <br />a <br /> <br />cable <br /> <br />television <br /> <br />system <br /> <br />to <br /> <br />TCI <br /> <br />Cablevision <br /> <br />of <br /> <br />California, Inc.; and <br /> <br />WHEREAS, the City is a member agency of the San Mateo County <br /> <br />Cable Television Authority, a joint exercise of powers authority <br /> <br />(IISAMCATII); and <br /> <br />WHEREAS, <br /> <br />the Federal Cable Television Consumer Protection <br /> <br />and Competition Act of 1992 <br /> <br />(the 111992 Cable Actll) <br /> <br />permi ts the <br /> <br />City to regulate certain cable television system rates; and <br /> <br />WHEREAS, <br /> <br />the <br /> <br />1992 <br /> <br />Cable <br /> <br />Act <br /> <br />directed <br /> <br />the <br /> <br />Federal <br /> <br />Communications Commission <br /> <br />(the <br /> <br />II FCCII ) <br /> <br />to establish regulations <br /> <br />and procedures implementing the aforesaid local authority; and <br /> <br />WHEREAS, <br /> <br />SAMCAT <br /> <br />has <br /> <br />agreed to <br /> <br />comply with all <br /> <br />rules <br /> <br />and <br /> <br />regulations <br /> <br />of <br /> <br />the <br /> <br />FCC <br /> <br />and <br /> <br />act <br /> <br />on <br /> <br />behalf <br /> <br />of <br /> <br />the <br /> <br />City <br /> <br />in <br /> <br />regulating said cable television rates; and <br /> <br />WHEREAS, <br /> <br />FCC <br /> <br />rules <br /> <br />provide <br /> <br />that <br /> <br />a <br /> <br />franchising <br /> <br />authority <br /> <br />which has been jointly certified for rate regulation with other <br /> <br />franchising <br /> <br />authorities <br /> <br />retains <br /> <br />independent <br /> <br />rate <br /> <br />regulatory <br /> <br />authority; and <br /> <br />WHEREAS, <br /> <br />this Council hereby finds and determines that it <br /> <br />would be economical and in the best interests and welfare of the <br /> <br />citizens <br /> <br />of <br /> <br />the <br /> <br />City <br /> <br />of <br /> <br />Redwood <br /> <br />City <br /> <br />to <br /> <br />delegate <br /> <br />certain <br />
