NOVAK and ANTOINETTE M. NOVAK, (hereinafter called "Novak") for <br />the settlement of all matters referred to herein and the relinquishment of access <br />rights alonp the hereinafter described property on Jefferson Avenue, Redwood <br />City, California. <br /> <br />Novak is the owner of the real ptP,}pfH1y located at 932 Middlefield Ro~d, <br />Redwood City, California, and more particularly described on Exhibit "A," <br />attached hereto and incorporated by this reference (the "Property"). <br /> <br />City and Novak desire to fully and finally settle all claims, issues, and <br />matters which have been raised in regard to the matters set forth below. It is <br />hereby mutually agreed between the parties as follows: <br /> <br />1. Aareement to Relinauish Access Riahts. Novak agrees to relinquish <br />access to and from the Property onto Jefferson Avenue (the "Relinquishment of <br />Access"). A diagram of the Property showing the Relinquishment of Access is <br />attact ,!9d hereto, marked Exhibit "B" and incorpo: ated by this reference. <br /> <br />2. Eminent Domain Dismissal. Nova~,: and City acknowledge that this <br />transaction is a negotiated settlement in lieu of condemnation, and Novak and <br />City hereby agree and consent to the abandonment of any eminent domain <br />and/or inverse condemnation action and Novak and City hereby each waive all <br />attorneys' fees, costs, disbursements, and expenses incurred in connection <br />therewith. <br /> <br />3. Waivers.
