ORIGINAL <br />AGREEMENT BETWEEN THE CITY OF REDWOOD CITY and SCOTT <br />GALET, as Conservator for OWNER <br />This Agreement is made and entered into this "/ day of _^I�2017, <br />by and between the CITY OF REDWOOD CITY, a charter city and municipal corporation <br />of the State Of California ("CITY") and SCOTT GALET, conservator of the person and <br />estate of Robert Galet ("CONSERVATOR"), (collectively referred to as "PARTIES"). <br />RECITALS <br />Robert Galet ("OWNER"), is the owner of the property located at 112-120 Vera <br />Avenue in Redwood City, California (San Mateo County Assessor's Parcel <br />Number 053-064-130) ("PROPERTY"). The PROPERTY contains ten vacant <br />residential units. <br />2. After extensive efforts to obtain compliance from OWNER to abate the public <br />nuisance conditions at the PROPERTY, the CITY's Building Official determined <br />that the buildings on the PROPERTY are a public nuisance as defined by Section <br />9.5 of the Redwood City Code, in part because the buildings, because of <br />dilapidation, deterioration and decay, have been determined to be unfit for human <br />habitation and subject to abatement by the CITY. <br />3. On April 3, 2017, the City Council of the CITY adopted Resolution 15574 declaring <br />the PROPERTY a public nuisance as defined by Section 9.5 of the Redwood City <br />Code and requiring OWNER to abate the declared public nuisance within thirty <br />(30) days from April 3, 2017 by either (a) properly reconstructing or repairing such <br />buildings or (b) razing or removing such buildings. Resolution 15547 further <br />notified OWNER that if he failed to abate such public nuisance within such thirty <br />(30) day period the CITY would abate the nuisance by razing and removing the <br />buildings and all of the expenses thereof would be made a lien on the PROPERTY. <br />4. OWNER was duly notified of the public hearing held prior to the adoption of <br />Resolution 15574 and failed to appear for the hearing. Although OWNER was <br />notified of the adoption of Resolution 15574, OWNER and CONSERVATOR have <br />failed to abate the public nuisance on the PROPERTY within the time limit <br />provided by Resolution 15574. <br />On May 2, 2017, OWNER was found by police in or around Roseville, California <br />suffering from severe physical and mental health issues. OWNER was <br />hospitalized and then discharged by ambulance to a rehabilitation facility in Palo <br />Alto, California. <br />6. While hospitalized, OWNER was induced to add a third party on title to the <br />PROPERTY ("VOID DEED").
