COPY <br />AGREEMENT <br />for <br />CONSTRUCTION OF WATER MAIN IMPROVEMENTS FROM <br />THE END OF EXISTING BRIDGE PARKWAY TO STATION <br />25+00± ON BRIDGE PARKWAY FOR WESTPORT OFFICE <br />PARK <br />THIS AGREEMENT, made and entered into this I� day of <br />1997, by and between the CITY OF REDWOOD CITY, a municipal corporation <br />of the State of California, ("City"), and WESTPORT JOINT VENTURE, a <br />California general partnership ("Owner"); <br />WITNESSETH: <br />WHEREAS, Owner proposes to construct certain water main <br />improvements in connection with the development of Westport Office Park (the <br />"Property"), situated in the City of Redwood City, County of San Mateo, State of <br />California; and <br />WHEREAS, City has requested that construction of certain improvements <br />(as defined below), title to which is proposed to be conveyed by Owner to City for <br />public purposes, be constructed at the Property, which improvements have been <br />represented by Owner not to be located above refuse, and are to be constructed <br />in accordance with, and as required by, the plans, specifications, and details <br />hereinafter described; and <br />NOW, THEREFORE, in order to ensure satisfactory performance by <br />Owner of Owner's obligations under Article VII, Chapter 29, General Street <br />Improvements of the Code of the City of Redwood City, and in consideration of <br />
