<br />DES:djk J\/30/90 (#041/28) <br /> <br />o R 'j <br /> <br />; HAL <br /> <br />12/10/90 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. 11452 <br /> <br />RESOLUTION SUSPENDING OPERATION OF SECTION 7.02 (b) OF <br />SETTLEMENT AGREEMENT AND MASTER WATER SALES CONTRACT <br />WITH THE CITY AND COUNTY OF SAN FRANCISCO FOR FISCAL <br />YEARS 1989-1990 AND 1990-1991 <br /> <br />WHEREAS, pursuant to water supply contract dated August 8, <br /> <br />1984 by and between the City and County of San Francisco ("San <br /> <br />Francisco") and the City of Redwood City, which contract <br /> <br />incorporates by reference the terms and conditions of that <br /> <br />certain "Settlement Agreement and Master Water Supply Contract" <br /> <br />(the "Master Agreement") between San Francisco and certain <br /> <br />suburban purchasers <br /> <br />(the "Suburban Purchasers"), this City <br /> <br />obtains its potable water supply from the Hetch Hetchy water <br /> <br />system; and <br /> <br />WHEREAS, Section 7.01 of the Master Agreement provides that <br /> <br />San Francisco shall supply to the Suburban Purchasers pursuant <br /> <br />thereto a maximum annual average metered supply of water defined <br /> <br />as the "Supply Assurance"; and <br /> <br />WHEREAS, Section 7.02(b) of the Master Agreement provides a <br /> <br />methodology for the allocation of the Supply Assurance among the <br /> <br />Suburban Purchasers and, further, provides for allocation of a <br /> <br />portion thereof designated as the "Suburban Allocable Water"; and <br /> <br />WHEREAS, <br /> <br />subject to agreement between <br /> <br />said <br /> <br />Suburban <br /> <br />Purchasers to the contrary, the allocation of the Supply <br /> <br />Assurance is based upon prior water usage by individual <br /> <br />purchasers; and <br />
