<br />ORIGINAL <br /> <br />AGREEMENT <br /> <br />INDEMNIFICATION AGREEMENT REGARDING TEMPORARY <br />CONSTRUCTION EASEMENT FOR <br />CONSTRUCTION OF STORM CULVERT IMPROVEMENTS <br /> <br />+~ <br />THIS AGREEMENT, made and entered into this L day of October <br /> <br />2005, by and between the City of Redwood City, a municipal corporation of the <br /> <br /> <br />State of California ("City"), and Harbor Village Mobile Home Park and Harbor <br /> <br />Village LLC. ("Owner") of the property known as the Harbor Village Mobile <br /> <br />Home Park (the Property") and described on Exhibit "A," to the document entitled <br /> <br />"Grant of Easement" described below. <br /> <br />WITNESSETH: <br /> <br />WHEREAS, Owner has agreed to allow City to use a portion of the <br /> <br />Property on the terms and conditions set forth in the agreement of even date <br /> <br />entitled "Grant of Easement" between City and Owner, a copy of which is <br /> <br />attached hereto, marked Exhibit "A," and incorporated by this reference. <br /> <br />NOW, THEREFORE, the parties hereto agree as follows: <br /> <br />1. Consideration. As consideration for the Grant of Easement and other <br /> <br />consideration, City shall pay Owner upon execution of the Grant of Easement the <br /> <br />sum of $7,732.08, which sum represents 6 months of parcel rent for spaces 440 <br /> <br />and 441, plus attorney's fees incurred by Owner relating to said easement, not <br /> <br />to exceed $5000.00, payable upon presentation to City of an itemized statement <br /> <br />of such fees from the Law Offices of Paul T.
