N A L 11/8/99 <br /> <br /> RESOLUTION NO. 13788 <br /> <br /> RESOLUTION OF THE COUNCIL OF THE CITY OF REDWOOD <br /> CITY APPROVING AND AUTHORIZING EXECUTION OF JOINT <br /> EXERCISE OF POWERS AGREEMENT FOR THE SOUTH <br /> BAYSIDE WASTE MANAGEMENT AUTHORITY <br /> <br /> WHEREAS, the City of Redwood City (the "City") is a member of the South <br /> Bayside Transfer Station Authority (SBTSA), a joint powers authority created by <br /> a joint exercise of powers agreement under California Government Code §§ 6500 <br /> et seq. in 1982; and <br /> <br /> WHEREAS, the SBTSA has heretofore exercised regulatory authority for <br /> its members with respect to the San Carlos Transfer Station and the San Mateo <br /> Recyclery located at 225, 229 & 333 Shoreway Rd., in San Carlos, California (the <br /> "Facilities"); and <br /> <br /> WHEREAS, the SBTSA has also exercised regulatory authority for its <br /> members with respect to the collection and disposal of solid waste and recyclable <br /> material by private collectors; and <br /> <br /> WHEREAS, the SBTSA has an option to acquire the Facilities from BFI <br /> Waste Systems of North America, Inc. (BFI) and an agreement for acquisition of <br /> the Facilities has been negotiated; and <br /> <br /> WHEREAS, it has been determined by the SBTSA members that a new <br />joint exercise of powers agreement should be entered into in establishing a new <br />joint powers authority (JPA) by those members who desire to obtain financing and <br />operate the Facilities, and also to continue to regulate collection of solid waste, <br />recyclable material and plant material as those are defined in the new JPA <br />agreement; and <br /> <br />Reso-778 <br />F:/Shared/Redwood/Co u ncil <br />DES:djk <br />11/03/99R 1 <br /> <br /> <br />
