5/17/99 <br /> - ORIGINAL <br /> <br /> RESOLUTION NO. 13634 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br /> AGREEMENT RELATING TO POLICE FACILITY ROOF DRAINAGE <br /> RECONSTRUCTION <br /> <br /> WHEREAS, the City of Redwood City and H. Wendell Mounce, A.I.A. & <br />Associates entered into an agreement dated January 12, 1990, thereafter <br />amended by first amendment dated July 23, 1990, and second amendment <br />dated April 30, 1991 (collectively, "Amhitect's Agreement), which was assigned to <br />Leach Mounce Amhitects ("Architect"); and <br /> <br /> WHEREAS, pursuant to Architect's Agreement, Architect designed and <br />prepared contract documents and rendered other services for the construction of <br />the City's new police facility (the "Facility"); and <br /> <br /> WHEREAS, the City and S. J. Amoroso Construction Co., Inc. <br /> ("Contractor") entered into an agreement dated October 1, 1991 (the <br /> "Construction Agreement"), pursuant to which Contractor constructed the Facility; <br /> and <br /> <br /> WHEREAS, on or about May 17, 1993, this Council accepted the Facility; <br /> and <br /> <br /> WHEREAS, subsequent to acceptance and occupancy of the Facility, <br /> substantial rainwater leakage occurred from the roof and related appurtenances, <br /> the exact cause of which (after substantial investigation) has not been <br /> ascertained; and <br /> <br /> Reso-497 <br /> P,S har ed/R edwood/Cou ncil <br /> DES:rg <br /> 09/09/98 <br /> <br /> <br />
