<br />DES:~~~ 04/29/88 <br /> <br />(#21) <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />10785 <br /> <br />ORIGINAL <br />MAY 2 1988 <br /> <br />RESOLUTION <br />TERMINATION <br />AGREEMENT <br /> <br />APPROVING AND AUTHORIZING EXECUTION OF <br />OF LEASE, COMPROMISE AND SETTLEMENT <br /> <br />(SAN FRANCISCO FORTY NINERS LEASE AGREEMENT) <br /> <br />WHEREAS, the City of Redwood City and the San Francisco <br /> <br />49'ers, a limited partnership (the "Forty Niners") entered into a <br /> <br />lease agreement, dated August 22, 1974, entitled "Lease Agreement <br /> <br />Community Park Recreation Building", which agreement was <br /> <br />amended by agreement dated April 22, 1981, entitled "Amendment to <br /> <br />Lease <br /> <br />Agreement <br /> <br />Community <br /> <br />Park <br /> <br />Recreation <br /> <br />Building" <br /> <br />(collectively, the "Lease"); and <br /> <br />WHEREAS, pursuant to subparagraph 1 (b) of the Lease, by <br />letter dated April 9, 1986, the Forty Niners exercised their <br /> <br />option to renew the Lease for an additional eight year term, <br /> <br />commencing August 1, 1986; and <br /> <br />WHEREAS, subsequent to exercising the aforesaid option, the <br /> <br />Forty Niners disclosed their desire to terminate the Lease; and <br /> <br />WHEREAS, this Council is willing to do so in resolution of <br /> <br />outstanding controversies between the parties described in the <br /> <br />agreement hereinafter referenced; and <br /> <br />WHEREAS, there has been presented to, and reviewed by, the <br /> <br />Termination of Lease, Compromise and Settlement Agreement between <br /> <br />the City and the Forty Niners, which agreement this Council <br /> <br />desires to approve; <br /> <br />NOW, THEREFORE; <br /> <br />10785 <br />
