<br />T)AS:djk 8/15/86 <br /> <br />RES 0 L UTI 0 N <br /> <br />!! o. 1 0 3 0 8 <br /> <br />ORIGINAL <br />AUG 1 8 1986 <br /> <br />RESOLUTION SUMMARILY VACATING A PUBLIC SERVICE <br />(OVERHANG) EASEMENT IN ACCORDANCE WITH PART 3, CHAPTER <br />4 OF DIVISION 9, STREETS AND HIGHWAYS CODE OF THE STATE <br />OF CALIFORNIA <br /> <br />WHEREAS, pursuant to the provisions of Part 3, Chapter 4 of <br /> <br />Division 9 of the Streets and Highways Code of the State of <br /> <br />California, (commencing with ~8300) the legislative body of a <br /> <br />local agency may summarily vacate a public service (overhang) <br /> <br />easement if such easement has not been used for the purpose for <br /> <br />which it was dedicated or acquired for five consecutive years <br /> <br />immediately preceding the proposed vacation; and <br /> <br />WHEREAS, the Westwood Terrace No. 1 subdivision map, which <br /> <br />was recorded on July 7, 1950 in Vol. 31 of Maps, at p. 43, shows <br /> <br />a public service (overhang) easement along the northeasterly line <br /> <br />of Lot 9, Block 2 ("Lot"); and <br /> <br />WHEREAS, said public service (overhang) easement has not <br /> <br />been used for the purpose for which it was dedicated for a period <br /> <br />in excess of five consecutive years immediately preceding this <br /> <br />proposed vacation; and <br /> <br />WHEREAS, the present owner of Lot wishes to utilize a <br /> <br />portion of the land within the said public service (overhang) <br /> <br />easement; and <br /> <br />WHEREAS , it is the desire of this Council to summarily <br /> <br />vacate the said public service (overhang) easement; <br /> <br />NOW, THEREFORE; <br /> <br />10308 <br />
