<br />DES:sh <br />DES:sh <br /> <br />6/28/85 <br />7/0l/85R <br />JUL 1 1985 <br /> <br />RES 0 L UTI 0 N <br /> <br />N O. <br /> <br />9920 <br /> <br />ORIGI NAL <br />PAYABLE <br /> <br />RESOLUTION PROVIDING ADJUSTMENT IN BENEFITS <br />UNDER FORMER POLICE RELIEF AND PENSION FUND <br /> <br />WHEREAS, prior to providing a means for participating by <br /> <br />contract in the California Public Employees Retirement System <br /> <br />under Government Code Sections 20450 et seq., <br /> <br />the State <br /> <br />Legislature authorized local public agencies to provide pension <br /> <br />and related benefits for police officers and their beneficiaries <br /> <br />under an act originally enacted in the Statutes of 1889 at page <br /> <br />56, thereafter amended and entitled, "An Act to Create a Police <br /> <br />Relief, Health, Life Insurance and Pension Fund in the Several <br /> <br />Counties, Cities and Counties, Cities and Towns of the State"; <br /> <br />and <br /> <br />WHEREAS, pursuant to judgment and order of the Superior <br /> <br />Court of the State of California in and for the County of San <br /> <br />Mateo dated and filed May 11, 1942 (Civil No. 33423), the City of <br /> <br />Redwood City established a Police Relief and Pension Fund under <br /> <br />the aforesaid Act for the benefit of survivor(s) of police <br /> <br />officer(s) of the City entitled to benefits thereunder, and not <br /> <br />entitled to benefits under the aforesaid Public Employees <br /> <br />Retirement System as later provided by contract for the City of <br /> <br />Redwood City; and <br /> <br />WHEREAS, since that time benefit payments have been made to <br /> <br />Margaret Fleishman, as surviving widow of Herman G. Fleishman, <br /> <br />who lost his life in the line of duty; and <br /> <br />WHEREAS, this Council, as successor to the Board of Police <br /> <br />Pension Fund Commissioners established pursuant to the aforesaid <br />
