0 R I G I N A L 5/19/97 <br /> <br /> RESOLUTION NO. 13084 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION <br /> OF AGREEMENT WITH THE FAIR OAKS SEWER <br /> MAINTENANCE DISTRICT AND THE TOWN OF WOODSIDE <br /> FOR SANITARY SEWERAGE TREATMENT CAPACITY RIGHTS <br /> AND SERVICES <br /> <br /> WHEREAS, City and the Fair Oaks Sewer Maintenance District <br />("District") entered into an agreement dated July 23, 1985, entitled, "Agreement - <br />Sanitary Sewerage Treatment Capacity Rights and Services" (the "Basic <br />Agreement"), providing for transmission, treatment, and disposal of sewage <br />emanating from District's service area; and <br /> <br /> WHEREAS, pursuant to Section (9) of the Basic Agreement, the services <br />furnished to District by City therein specified, and the Treatment Capacity Rights <br />reserved and conveyed to District thereunder are expressly limited to sewage <br />emanating from property situated within the service area of District; and <br /> <br /> WHEREAS, Woodside has provided for the installation and construction <br />of sewerage collection and transmission facilities for certain lands located within <br />its corporate boundaries; and <br /> <br /> WHEREAS, the Town Center Sewer Assessment District ('q'CSAD") <br />comprises a portion of the incorporated territory of Woodside; and <br /> <br /> WHEREAS, TCSAD is located within the sanitary sewage service area <br /> ("Service Area") of the South Bayside System Authority ("Authority") which <br /> <br /> Reso-172 1 <br /> G :~s hared~redwood'~cou ncil <br /> FXS:rg <br /> 04/14/97 <br /> <br /> <br />
