06/25/2007 ORIGINAL ORDINANCE NO. 2311 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD CITY DESCRIBING THE REDWOOD CITY REDEVELOPMENT AGENCY'S PROGRAM TO ACQUIRE REAL PROPERTY BY EMINENT DOMAIN PURSUANT TO THE REDEVELOPMENT PLAN FOR PROJECT AREA NO, 2 WHEAREAS, the Council of Redwood City (the "Council") adopted the Redevelopment Plan for Redevelopment Project Area No. 2 (the "Project Area") on August 19,1982 by Ordinance No. 1862 and has amended the Redevelopment Plan as follows: by Ordinance No. 1911 approved on June 20,1985; by Ordinance No. 2007 approved on January 18, 1990; by Ordinance No. 2085 approved on December 19, 1994; by Ordinance No. 2211 approved on July 9, 2001 (as amended the "Redevelopment Plan"); and WHEREAS, the Community Redevelopment law (the "CRl;" California Health and Safety Code Section 33000 et seq.) permits the adoption of redevelopment plans, redevelopment plan amendments, and redevelopment plan mergers; and WHEREAS, Senate Bill 53 (Kehoe) ("SB 53"), adopted by the California legislature during the 2006 legislative Session and codified as California Health and Safety Code section 33342.7, requires that a Redevelopment Agency which adopted a final redevelopment plan on or before January 1, 2007 to adopt an ordinance describing the Agency's program to acquire property by eminent domain (the "Program"); and WHEREAS, the Council desires to adopt this Ordinance to describe the Program as required by SB 53 and Section 33342.7. NOW, THEREFORE, THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: SECTION 1. The purpose and intent of the Council in adopting this Ordinance is to comply with SB 53 and Health and Safety Code section 33342.7. The overall object of the Agency is to continue its efforts to eliminate or alleviate conditions of blight; ensure, as far as possible, that the causes of blighting conditions will either be eliminated or protected against; encourage and ensure the redevelopment of the Project Area; encourage and foster the economic revitalization of the Project Area, as necessary; and provide and improve affordable housing. SECTION 2. The Council hereby adopts and approves the description of the Agency's program to acquire property by eminent domain (the "Program") as more fully described in Exhibit "A" attached hereto and incorporated herein by this reference.
