09/19/2011 <br /> ORIGINAL <br /> RESOLUTION NO. 15147 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> CITY VACATING A PUBLIC RIGHT OF WAY ADJACENT TO 1410 <br /> VALOTA ROAD <br /> WHEREAS, the City of Redwood City ("City") is responsible for the public right- <br /> of-way as dedicated on that certain Map entitled "Map of Valota Park, San Mateo <br /> County, California, filed for record on October 5, 1910 in the Office of the Recorder of <br /> San Mateo County, in Book 7 of Maps at Page 34; and <br /> WHEREAS, the total area of said vacation to be 1,060 square feet, more or less, <br /> WHEREAS, a condition for authorization to approve the planned development <br /> proposed at 1410 Valota Road requires disposition of this vacation area prior to <br /> submittal of Vesting Tentative Map and Final Subdivision Map; and <br /> WHEREAS, to effectuate the above-mentioned planned development proposal <br /> by the 1410 Vafota Road Partners, LIC, the City will need to vacate a portion of a the <br /> Valota Road right of way, identified as the shaded triangular area depicted and <br /> described on Exhibit "A", attached hereto ("Vacation Area"); and <br /> WHEREAS, the City has determined that the Vacation Area for a period of five <br /> consecutive years has been impassable for vehicular travel; and <br /> WHEREAS, no public money was expended for maintenance on the street or <br /> portion of right of way as described in the Vacation Area by the City within the past 5 <br /> years; and <br /> WHEREAS, Section 8331 of the Streets and Highways Code of the State of <br /> California allows a city to summarily vacate a public service easement if "for a period of <br /> five consecutive years, the portion of street or highway has been impassable for <br /> vehicular travel, and no public money was expended for maintenance on the portion of <br /> street of highway during such period."; and <br /> WHEREAS, relocation of the existing hydrant out of the vacated area by the <br /> developer of the above-mentioned planned development will be condition of this <br /> vacation. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br /> OF REDWOOD CITY AS FOLLOWS: <br /> AIIY/RES02160/SUMMARY VACATION OF PUBLIC RIGHT OF WAY - VALOTA RD. � Reso. # 15747 <br /> 091411 MUFF # 606 <br /> 1 <br />
