07/23/2018 <br />RESOLUTION NO. 15690 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br />CITY PROPOSING AMENDMENTS TO SECTIONS 1.16, 1.36, 3.2, 3.3, <br />6.5, 6.6, AND 6.7 OF JOINT EXERCISE OF POWERS AGREEMENT <br />ESTABLISHING SOUTH BAYSIDE SYSTEM AUTHORITY, NOW <br />KNOWN AS SILICON VALLEY CLEAN WATER, RELATING TO THE <br />DESIGNATIONS AND ASSIGNMENTS OF TREASURER AND <br />CONTROLLER OF THE AUTHORITY <br />WHEREAS, the South Bayside System Authority, now known as Silicon Valley <br />Clean Water ("SVCW" or the "Authority"), was established by Joint Exercise of Powers <br />Agreement dated November 13, 1975, entitled "Joint Exercise of Powers Agreement — <br />South Bayside System Authority" ("Agreement") pursuant to the Joint Exercise of <br />Powers Act (Chapter 5, commencing with Section 6500 of Division 7 of Title 1 of the <br />California Government Code) ("Act"); and <br />WHEREAS, the Agreement has heretofore been amended by seven (7) <br />Supplemental Agreements, dated for convenience as of June 8, 1977, June 1, 1983, <br />April 26, 1984, September 18, 1985, March 13, 2008, March 8, 2012, and December <br />12, 2013, respectively; and <br />WHEREAS, Sections 1.16, 1.36, and 3.2 of the Agreement identify and <br />designate the City of Redwood City, one of the parties to the Agreement, as the <br />Controller and Treasurer of the Authority in accordance with the Act; and <br />WHEREAS, Sections 3.3, 6.5, 6.6, and 6.7 of the Agreement delineate the duties <br />and obligations of the Controller and Treasurer in accordance with the Act; and <br />WHEREAS, SVCW has evolved since its original formation and now has a Chief <br />Financial Officer capable of performing the functions of the Authority's Treasurer in <br />order to meet the needs of the Authority's expanded operations; and <br />ATTY/RESO.0070/CC RESO SILICON VALLEY CLEAN WATER JPA AMENDMENTS RESO.
