<br />DES- ;1 07/05/88 <br /> <br />(#22) <br />ORIGINAL <br />JUt 1 1 1988 <br /> <br />RES 0 L UTI 0 N <br /> <br />No.10826 <br /> <br />RESOLUTION APPROVING AND AUTHORIZING <br />SUPPLEMENTAL AGREEMENT TO AGREEMENT <br />SEWER MAINTENANCE DISTRICT, COUNTY <br />CONSENTING TO ANNEXATION OF CERTAIN <br />DISTRICT <br /> <br />EXECUTION OF FIRST <br />WITH FAIR OAKS <br />OF SAN MATEO, <br />TERRITORY TO SAID <br /> <br />WHEREAS, the City of Redwood City ("City") and the Fair Oaks <br /> <br />Sewer Maintenance District ("District") entered into an agreement <br /> <br />entitled "Agreement - Sanitary Sewerage Treatment Capacity Rights <br /> <br />and Services", dated August 27, 1985 ("Basic Agreement") pursuant <br /> <br />to which the City provides sanitary sewerage transmission, <br /> <br />treatment and disposal services for sewage emanating from <br /> <br />District's territory; and <br /> <br />WHEREAS, pursuant to paragraph nine of the Basic Agreement, <br /> <br />services furnished, and Capacity Rights reserved and conveyed to <br /> <br />the District are expressly limited to sewage emanating from <br /> <br />property situated wi thin the service area of the District as <br /> <br />described in Exhibit "c" of the Basic Agreement; and <br /> <br />WHEREAS, an owner of land outside the District's existing <br /> <br />boundaries has applied to the District for annexation of said <br /> <br />land thereto, and District, in turn, has requested this Council <br /> <br />to consent thereto; and <br /> <br />WHEREAS, paragraph eighteen of the Basic Agreement provides <br /> <br />that said Agreement may from time to time be revised, altered, <br /> <br />amended or supplemented by written agreement; and <br /> <br />WHEREAS, there has been presented to, and reviewed by, this <br /> <br />Council a First Supplemental Agreement to the Basic Agreement <br /> <br />consenting to annexation of the above mentioned lands, subject to <br /> <br />the condition therein stated that said annexation shall not <br /> <br />10826 <br />
