09/24/2012 <br /> ORIGINAL <br /> ORDINANCE NO. 2388 <br /> ORDINANCE OF THE CITY OF REDWOOD CITY AMENDING <br /> ORDINANCE NUMBER 785 RELATING TO PROCEEDINGS <br /> HERETOFORE OR HEREAFTER TAKEN PURSUANT TO THE <br /> PARKING DISTRICT LAW OF 1951 <br /> WHEREAS, on January 17, 1955, the City Council of the City of Redwood <br /> City ("City Council") adopted Ordinance No. 785, title "An Ordinance relating to <br /> Proceedings Heretofore or Hereafter Taken pursuant to the Parking District Law <br /> of 1951," authorizing the formation of a parking district and establishing the <br /> procedures for such parking district; and <br /> WHEREAS, the purpose of this amendment is to (a) provide the City with <br /> more flexibility to use the proceeds of City's sale of property, and (b) clarify the <br /> meaning of the Ordinance to specifically state that this Ordinance supersedes <br /> and controls over the Parking District Law of 1951. <br /> NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD CITY DOES <br /> ORDAIN AS FOLLOWS: <br /> SECTION 1. The recitals set forth above are true and correct, and <br /> constitute findings incorporated herein by this reference as if fully set forth in their <br /> entirety. <br /> SECTION 2. Section 1 of Ordinance No. 785 is hereby amended to read <br /> as follows: <br /> "1. Ordinance Takes Precedence. Pursuant to the authority granted in the <br /> City of Redwood City charter, the provisions of this ordinance supersede and <br /> control over the provisions of the Parking District Law of 1951, California Streets <br /> & Highways Code Sections 35100 et seq., both where the provisions are <br /> inconsistent and also where the subject matter is addressed completely in this <br /> ordinance." <br /> SECTION 3. Section 17 of Ordinance No. 785 is hereby amended to read <br /> as follows: <br /> "17. Sale of Property. In the event that any parcel of property acquired <br /> from the proceeds of these bonds, or any improvements, extensions or <br /> replacements thereof or additions thereto shall hereafter be sold and disposed of, <br /> either during or after the term of the bonds, the proceeds of the sale shall be <br /> used for the following purposes: <br /> ATTY/ORD.378/AMENDING ORD 785 RELATING TO PROCEEDINGS ORD.#2388 <br /> TAKEN PURSUANT TO THE PARKING DISTRICT LAW OF 1951 MUFF#305 <br /> REV:08-14-12 VR <br /> Page 1 of 2 <br />
