09/09/2013 <br /> ORIGINAL <br /> ORDINANCE NO. 2397 <br /> ORDINANCE OF THE CITY COUNCIL OF THE CITY OF REDWOOD <br /> CITY AMENDING ORDINANCE NO. 2376 BY MODIFYING THE <br /> BOUNDARIES OF THE ESTABLISHED MIDDLEFIELD ROAD <br /> UNDERGROUND UTILITY DISTRICT NO. 2011-1 TO INCLUDE <br /> ADDITIONAL TERRITORY AND EXCLUDE OTHER TERRITORY AND <br /> BY EXTENDING THE REMOVAL DATE FOR OVERHEAD UTILITIES <br /> WHEREAS, on February 6, 2012, the City of Redwood City adopted Ordinance <br /> No. 2376 establishing the Middlefield Road Underground Utility District No. 2011-1 to <br /> remove existing overhead utility lines and other appurtenances and place said utility <br /> lines and other appurten�nces underground on Middlefield Road between Main Street <br /> and MacArthur Avenue; and <br /> WHEREAS, Redwood City now proposes to modify the boundaries of the MUUD <br /> to exclude certain territory and include additional territory and to extend the removal <br /> date for all overhead facilities within the district one year to provide more construction <br /> time for the project; and <br /> WHEREAS, the Community Development Department for the City of Redwood <br /> City has consulted with the affected public utilities and such utilities have agreed that <br /> additional territory should be included and other territory excluded from the established <br /> Middlefield Road Underground Utility District No. 2011-1, as more particularly described <br /> in Amended Exhibit "A" (legal description) and Amended Exhibit "B" (boundary map) <br /> attached hereto and incorporated herein by reference; and <br /> WHEREAS, the City Council has now received the report from the Community <br /> Development Director recommending that the boundaries of the established Middlefield <br /> Road Underground Utility District No. 2011-1 should be modified to include additional <br /> territory and exclude other territory, as identified in Amended Exhibits "A" and "B" <br /> hereto; and <br /> WHEREAS, the proposed boundary modification of Middlefield Road <br /> Underground Utility District No. 2011-1 is categorically exempt from environmental <br /> review pursuant to the California Environmental Quality Act; and <br /> WHEREAS, pursuant to the provisions of Article II of Chapter 11 of the Code of <br /> the City of Redwood City (commencing with §11.30), proceedings for the modification of <br /> the boundaries of the Middlefield Road Underground Utility District No. 2011-1 were <br /> instituted by Resolution No. 15285, adopted July 22, 2013; and <br /> ATTY/ORD.392/MIDDLEFIELD UUD DISTRICT AMENDMENT ORD.#2397 <br /> REV:08/16/13 VR Formerly MUFF#804 <br />
