<br />09/14/2009 <br /> <br />ORIGINAL <br /> <br />ORDINANCE NO. 2347 <br /> <br />AN ORDINANCE OF THE CITY COUNCil OF REDWOOD CITY <br />AMENDING SECTION 14.1, SECTION 14.10, AND SECTION <br />14.17 OF CHAPTER 14 OF THE REDWOOD CITY MUNICIPAL <br />CODE <br /> <br />WHEREAS, the theft of recyclable materials creates a nuisance in <br />neighborhoods, adversely affects the revenue stream of the City's authorized <br />recycling agent, and could consequently lead to increased garbage collection <br />fees; and <br /> <br />WHEREAS, the City wishes to prevent the unauthorized removal of <br />recyclable material from curbside bins; and <br /> <br />WHEREAS, the theft of recyclable materials is a violation of the California <br />Public Resources Code section 41950 et. seq.; and <br /> <br />WHEREAS, California Public Resources Code section 41954 allows local <br />agencies to enforce ordinances and impose civil penalties for the theft of <br />recyclable material from curbside bins; and <br /> <br />WHEREAS, the City wishes to issue citations for violations of this state <br />law and corresponding City ordinance as infractions. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF <br />THE CITY OF REDWOOD CITY AS FOllOWS: <br /> <br />SECTION 1. The Sections 14.1, 14.10, and 14.17 of Chapter 14 of the <br />Redwood City Municipal Code are hereby amended to read as follows: <br /> <br />Section 14.1. <br /> <br />DEFINITIONS: <br /> <br />For the purposes of this Chapter, the following words and phrases shall <br />have the meanings respectively ascribed to them in this Section: <br /> <br />GARBAGE: Shall mean and be held to include all animal and vegetable wastes <br />from kitchens, all household wastes that shall have been prepared for or <br />intended to be used as food or shall have resulted from the preparation of food <br />and, also, every accumulation of animal and vegetable waste material for the <br />establishments where foodstuffs intended for human consumption are handled <br />commercially. <br /> <br />ATTY/ORD/ORD.321 <br />081209 <br /> <br />1 <br /> <br />2347 <br />FORMERLY MUFF # 803 <br />
