Section 2.55 of the Code of the City of Redwood City is hereby amended to read as follows: "Section 2.55. Disposition of Property Not Covered by Section 2.54. Except as provided in Section 2.54, unclaimed property in the possession of the police department shall be disposed of as follows

<br />DES:djk 06/04/91 (010/9) <br /> <br />ORIGINAL <br />July 8, 1991 <br /> <br />ORDINANCE NO. 2039 <br />--------- <br /> <br />ORDINANCE AMENDING SECTION 2.55 OF THE CODE OF THE CITY <br />OF REDWOOD CITY RELATING TO THE DISPOSITION OF <br />UNCLAIMED PROPERTY TO ALLOW FOR THE USE OF UNCLAIMED <br />BICYCLES OR TOYS IN PROGRAMS FOR THE PREVENTION OF <br />JUVENILE DELINQUENCY <br /> <br /> <br />THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: <br /> <br />SECTION 1. Section 2.55 of the Code of the City of Redwood <br /> <br />City is hereby amended to read as follows: <br /> <br />"Section 2.55. Disposition of Property Not Covered by <br /> <br />Section 2.54. Except as provided in Section 2.54, unclaimed <br /> <br />property in the possession of the police department shall be <br /> <br />disposed of as follows: <br /> <br />(a) Said property shall be released to the owner <br />thereof upon proof of ownership and if said owner <br />makes claim therefor within a period of four (4) <br />consecutive months commencing on the date of <br />possession by the police department, or a period <br />of three (3) consecut.ive months in the case of <br />unclaimed bicycles. Said owner shall be required <br />to pay a reasonable charge to defray costs of <br />storage and care of the property as a condition to <br />the release thereof. <br /> <br />(b) If said property is not claimed in accordance with <br />the provisions of subsection (a) hereof it shall <br />be disposed of as follows: <br /> <br />(1) Said property may, upon determination by the <br />chief of police, be found to be needed for a <br />public use and be used therefor. <br /> <br />(2) Said property may be sold at public auct.ion <br />to the highest bidder after notice given <br />therefor by the chief of police at least five <br />(5) days before the time fixed for such sale <br />by publication once in a newspaper of general <br />circulation published in the City. In the <br />event no bid is offered for said property at <br />such auction, the same shall be retained, <br />used, or disposed of as directed by the chief <br />of police. <br /> <br /> <br /> <br /> <br /> <br />2039 <br />
