ORDINANCE NO. 2152 <br /> <br /> ORDINANCE ADDING ARTICLE HEADING I FOR SECTIONS 15.1-15.7 <br /> AND REPEALING SECTION 15.8 OF, AND ADDING ARTICLES II, III, <br /> AND IV TO, CHAPTER 15 OF THE CODE OF CITY OF REDWOOD CITY <br /> RELATING TO LOCAL SMOKING REGULATIONS, ENFORCEMENT OF <br /> STATEWlDE SMOKING PROHIBITIONS, TOBACCO RETAIL PERMITS <br /> AND PENALTIES FOR VIOLATIONS OF THE PROVISIONS OF SAID <br /> CHAPTER, RESPECTIVELY. <br /> <br /> THE COUNCIL OF REDWOOD CITY DOES ORDAIN AS FOLLOWS: <br /> Section 1. Findings. This Council hereby finds and declares that: <br /> <br /> (a) Sections 15.1 through 15.7 of the Code of the City of Redwood City, as <br />added by Ordinance No. 1969, adopted June 20, 1988, established regulations <br />regarding smoking in the City of Redwood City (the "Local Regulations"); <br /> <br /> (b) Labor Code Section 6404.5, as added by Chapter 13, statutes of 1994 <br /> (Assembly Bill 13), as subsequently amended, established uniform statewide <br /> standards regarding smoking regulations governing places of work (the "Statewide <br /> Regulations"); <br /> <br /> (c) To the extent that the Local Regulations are not in conflict with the <br /> Statewide Regulations, it is the intent of this Council that the Local Regulations shall <br /> remain in full force and effect; <br /> <br /> (d) By delegation, the Director of Health Services of San Mateo County, <br /> Mateo County Health Services Agency, or his or her designated representative, a¢~ <br /> through the Division of Public Health, is the "Health Officer" of the City of Redw. <br /> City for purposes of the City's Environmental Health Code (?edwood City <br /> Sections 13.1, et seq.); <br /> <br /> (e) The San Mateo County Health Services Agency, through its Division of <br /> Public Health, enforces the provisions of Labor Code Section 6404.5 in the County of <br /> San Mateo, and is willing to provide such enforcement, by delegation, within the City <br /> of Redwood City; <br /> <br /> (f) This Council desires to so delegate such authority and the previsions of <br /> Article II added to Chapter 15 of the Code of the City of Redwood City pursuant to this <br /> ordinance effectuate such delegation to the City's Health Officer; <br /> <br /> (g) Penal Code Section 308(a) prohibits the sale of tobacco products and <br /> paraphernalia to minors; <br /> <br />Ord-040 ] <br />f/shlshlRC/Council <br />DES:rr;rg <br />08/19/98; 09/22/98R:09/28/98R <br /> <br /> <br />
