DES:djk 42/18/95 (053/41) <br /> DES:djk _~./05/96R <br /> 0 R I G I N A L 1/22/96 <br /> <br /> R E S O L U T I 0 N N O. 12684 <br /> <br /> RESOLUTION AUTHORIZING ACCEPTANCE OF A PUBLIC STREET <br /> EASEMENT, A PUBLIC SERVICE EASEMENT, A WATERLINE <br /> EASEMENT AND RELINQUISHMENT OF ACCESS RIGHTS; AND <br /> SUMMARILY VACATING A PORTION OF A PUBLIC SERVICE <br /> EASEMENT AND NON-ACCESS RESTRICTION SUPERCEDED BY <br /> RELOCATION <br /> <br /> (330 AND 350 TWIN DOLPHIN DRIVE) <br /> <br /> WHEREAS, pursuant to the provisions of Chapter 4 (commencing <br />with §8330), Part 3, Division 9 of the Streets and Highways Code <br />of the State of California, this Council may summarily vacate a <br />non-access restriction if such non-access restriction has been <br />superceded by relocation; and <br /> <br /> WHEREAS, a portion of the non-access restriction as shown on <br />Parcel C of that certain map entitled "Parcel Map No. 83-7", <br />filed November 29, 1983 in Volume 54 of Maps at Page 11, Official <br />Records of San Mateo County, is no longer required for public <br />use, provided, that a portion of said non-access restriction <br />shall be relocated; and <br /> <br /> WHEREAS, the owner of record of the property affected <br />thereby proposes to convey to the City, easements for public <br />street, public service and waterline purposes, proposes to <br />relinquish access rights at a new location in exchange for the <br />portion of the non-access restriction to be vacated; and <br /> <br /> WHEREAS, the value of the property interests to be received <br />by the City pursuant to said exchange equals or exceeds the value <br />of the property interests to be vacated; <br /> <br /> <br />
