~ DES :dju 03/20/96 (084/41) <br /> 0 R I G I N A L 4/8/96 <br /> <br /> R E S O L U T I O N N O. 12718 <br /> <br /> RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF FIRST <br /> AMENDMENT TO THE AMENDED JOINT POWERS AGREEMENT <br /> ESTABLISHING THE ALCOHOL VIOLATION TEMPORARY HOUSING <br /> AUTHORITY <br /> <br /> WHEREAS, pursuant to the provisions of Resolution No. 11738, <br /> adopted April 27, 1992, this Council approved a Joint Powers <br /> Agreement Establishing the Alcohol Violation Temporary Authority; <br /> and <br /> <br /> WHEREAS, pursuant to Resolution No. 11995, adopted June 7, <br /> 1993, this Council entered into a First Amended Joint Powers <br /> Agreement Establishing the Alcohol Violation Temporary Housing <br /> Authority; and <br /> <br /> WHEREAS, pursuant to Resolution No. 12224, adopted June 27, <br /> 1994, this Council entered into a Second Amended Joint Powers <br /> Agreement Establishing the Alcohol Violation Temporary Housing <br /> Authority; and <br /> <br /> WHEREAS, a First Amendment to the Amended Joint Powers <br /> Agreement Establishing the Alcohol Violation Temporary Housing <br /> Authority (the "First Amendment to Amended Agreement") has been <br /> presented to, and reviewed by, this Council; and <br /> <br /> WHEREAS, under the First Amendment to the Amended Agreement <br /> the parties thereto shall continue to provide an alternative <br /> method of caring for certain persons accused of violations of law <br /> based on being under the influence of alcohol or drugs in lieu of <br /> incarceration; and <br /> <br /> <br />
